Sunan Abi Dawud 4593
Abu Hurayrah ( رضئهللا تعالی عنہ) narrated that the Prophet (صلى الله عليه وآله وسلم) said, no retaliation is payable for a wound caused by a dumb animal, for a mine, and for a well. On the treasure found buried in the land there is a fifth (portion payable to the Government). Imam Abu Dawood said, a dumb animal means an animal which is free and has not tether, and there is no one (as a watchman) with it. It causes harm by day and not by night.

ابوہریرہ رضی اللہ عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: جانور کسی کو زخمی کر دے تو اس میں ہرجانہ نہیں ہے، کان میں ہلاک ہونے والے کا ہرجانہ نہیں ہے اور کنواں میں ہلاک ہو جانے والے کا ہرجانہ نہیں ہے ۱؎ اور رکاز میں پانچواں حصہ دینا ہو گا ۔ ابوداؤد کہتے ہیں: جانور سے مراد وہ جانور ہے جو چھڑا کر بھاگ گیا ہو اور اس کے ساتھ کوئی نہ ہو اور دن ہو، رات نہ ہو۔
Abu Hurayrah (رضي الله تعالى عنه) kehte hain ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: Janwar kisi ko zakhmi kar de to is mein harjana nahin hai, kan mein halak hone wala ka harjana nahin hai aur kunwan mein halak ho jaane wala ka harjana nahin hai 1؎ aur rukaz mein panchwa hissa dena hoga. Abudaudd kehte hain: Janwar se mraad woh janwar hai jo chhura kar bhaag gaya ho aur uske saath koi nah ho aur din ho, raat nah ho.
حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، سَمِعَا أَبَا هُرَيْرَةَ يُحَدِّثُ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: الْعَجْمَاءُ جُرْحُهَا جُبَارٌ، وَالْمَعْدِنُ جُبَارٌ، وَالْبِئْرُ جُبَارٌ، وَفِي الرِّكَازِ الْخُمْسُ ، قَالَ أَبُو دَاوُد: الْعَجْمَاءُ الْمُنْفَلِتَةُ الَّتِي لَا يَكُونُ مَعَهَا أَحَدٌ، وَتَكُونُ بِالنَّهَارِ لَا تَكُونُ بِاللَّيْلِ.
