Musnad Ahmad ibn Hanbal 10467
Narrated Abu Huraira: The Prophet (ﷺ) said, "Two women of Bani Hudhail quarreled with each other, and one of them threw a stone at the other who was pregnant and killed her along with her fetus. The Prophet (ﷺ) judged regarding that case that the blood money (of the pregnant woman) was to be paid by the relatives of the killer woman, and (as for the blood money) of the fetus, a Ghura (i.e. a slave or a female slave) should be given. A man from the people said, "O Allah's Messenger (ﷺ)! How could he (i.e. the fetus) have retaliated (or punished) though he neither ate nor drank, nor did he relieve himself, nor cry? " The Prophet (ﷺ) said, "This (man) is one of the brothers of the poets (i.e., he speaks nonsensically as the poets do.) Yes, a Ghura (i.e. a slave or a female slave) is obligatory in this case." (He said, "A Ghura) twice.)

حضرت ابوہریرہ رضی اللہ عنہ سے مروی ہے کہ نبی کریم ﷺ نے فرمایا بنوہذیل کی دو عورتوں کے درمیان جھگڑا ہوگیا ان میں سے ایک نے دوسری کو جو امید سے تھی پتھر دے مارا اور اس عورت کو قتل کردیا اس کے پیٹ کا بچہ بھی مرا ہوا پیدا ہوگیا نبی کریم ﷺ نے اس مسئلے میں قاتلہ کے خاندان والوں پر مقتولہ کی دیت اور اس کے بچے کے حوالے سے ایک غرہ یعنی غلام یا باندی کا فیصلہ فرمایا اس فیصلے پر ایک شخص نے اعتراض کرتے ہوئے (مسجع کلام میں) کہا کہ اس بچے کی دیت کا فیصلہ کیسے عقل میں آسکتا ہے جس نے کچھ کھایا پیا اور نہ بولا چلایا اس قسم کی چیزوں کو تو چھوڑ دیا جاتا ہے بقول حضرت ابوہریرہ رضی اللہ عنہ کے نبی کریم ﷺ نے فرمایا یہ شخص شاعروں کی طرح (مقفی عبارتیں) بول رہا ہے ہاں اس میں غرہ یعنی غلام یا باندی ہی واجب ہے۔
Hazrat Abu Hurairah (رضي الله تعالى عنه) se marvi hai ki Nabi Kareem (صلى الله عليه وآله وسلم) ne farmaya Banu Hudhail ki do auraton ke darmiyaan jhagda hogaya In mein se aik ne dusri ko jo umeed se thi pathar de maara aur is aurat ko qatal kardiya Uske pet ka bachcha bhi mara hua paida hogaya Nabi Kareem (صلى الله عليه وآله وسلم) ne is masle mein qatila ke khandan walon par maqtula ki deet aur uske bachche ke hawale se ek ghura yani ghulam ya bandi ka faisla farmaya Is faisle par ek shakhs ne aitraz karte hue (musajja kalaam mein) kaha ki is bachche ki deet ka faisla kaise aql mein aa sakta hai jisne kuch khaya piya aur na bola chalaya Is qism ki cheezon ko to chhod diya jata hai Baqol Hazrat Abu Hurairah (رضي الله تعالى عنه) ke Nabi Kareem (صلى الله عليه وآله وسلم) ne farmaya yeh shakhs shairon ki tarah (muqfi ibaraten) bol raha hai Haan is mein ghura yani ghulam ya bandi hi wajib hai.
حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا مُحَمَّدُ بْنُ عَمْرٍو ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ , قََالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْجَنِينِ بِغُرَّةٍ: عَبْدٍ أَوْ أَمَةٍ، فَقَالَ الَّذِي قَضَى عَلَيْهِ: أَيُعْقَلُ مَنْ لَا شَرِبَ، وَلَا أَكَلَ، وَلَا صَاحَ فَاسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " إِنَّ هَذَا لَيَقُولُ بِقَوْلِ شَاعِرٍ، نَعَمْ، فِيهِ غُرَّةٌ: عَبْدٌ أَوْ أَمَةٌ" .
