Musnad Ahmad ibn Hanbal 10953
Narrated by Abu Hurairah (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) said: Two women of Banu Hudhail quarreled and one of them hit the other, who was pregnant, with a stone and killed her. The child in her womb was also found dead. The Prophet (peace and blessings of Allah be upon him) ruled that the compensation in this matter would be a Gharah (i.e., a slave or a bondwoman). Then the woman, against whom the Gharah was ruled, died, so the Prophet (peace and blessings of Allah be upon him) ruled that her inheritance would go to her sons and husband and the blood money would be upon her tribe.

حضرت ابوہریرہ رضی اللہ عنہ سے مروی ہے کہ نبی کریم ﷺ نے فرمایا بنوہذیل کی دو عورتوں کے درمیان جھگڑا ہوگیا ان میں سے ایک نے دوسری کو جو امید سے تھی پتھر دے مارا اور اس عورت کو قتل کردیا اس کے پیٹ کا بچہ بھی مرا ہوا پیدا ہوگیا نبی کریم ﷺ نے اس مسئلے میں ایک غرہ یعنی غلام یا باندی کا فیصلہ فرمایا پھر وہ عورت جس کے خلاف غرہ کا فیصلہ ہوا تھا وہ فوت ہوگئی تو نبی کریم ﷺ نے یہ فیصلہ فرمایا کہ اس کی وراثت اس کے بیٹوں اور شوہر کو ملے گی اور دیت اس کے عصبہ پر ہوگی۔
Hazrat Abu Huraira (رضي الله تعالى عنه) se marvi hai keh Nabi Kareem (صلى الله عليه وآله وسلم) ne farmaya Banu Hudail ki do aurton ke darmiyan jhagda hogaya in mein se ek ne dusri ko jo umeed se thi pathar de mara aur is aurat ko qatal kardiya is ke pet ka bachcha bhi mara hua paida hogaya Nabi Kareem (صلى الله عليه وآله وسلم) ne is masle mein ek ghura yani ghulam ya bandi ka faisla farmaya phir wo aurat jis ke khilaf ghura ka faisla hua tha wo foot hogayi to Nabi Kareem (صلى الله عليه وآله وسلم) ne ye faisla farmaya keh is ki wirasat is ke beton aur shohar ko milegi aur deet is ke asba par hogi.
حَدَّثَنَا هَاشِمٌ , حَدَّثَنَا لَيْثٌ , حَدَّثَنِي بْنُ شِهَابٍ , عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ , عَنْ أَبِي هُرَيْرَةَ , أَنَّهُ قَالَ:" قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لِحْيَانَ مِنْ هُذَيْلٍ , سَقَطَ مَيِّتًا , بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ , ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ , فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنَّ مِيرَاثَهَا لِبَنِيهَا وَزَوْجِهَا، وَأَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا" , حَدَّثَنَا إِسْحَاق بْنُ عِيسَى , حَدَّثَنَا لَيْثٌ , حَدَّثَنِي بْنُ شِهَابٍ , فَذَكَرَ مِثْلَهُ , إِلَّا أَنَّهُ قَالَ: ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ.
