Musnad Ahmad ibn Hanbal 1501
Sayyiduna Sa'd (may Allah be pleased with him) narrates that the Prophet (peace and blessings of Allah be upon him) set the limit of one-third for my will. He (peace and blessings of Allah be upon him) had come to visit me when I was ill. He (peace and blessings of Allah be upon him) asked me, "Have you made a will?" I said, "Yes! I have made a will to donate all my wealth to the poor, needy and travelers." He (peace and blessings of Allah be upon him) said, "Do not do that." I said, "But my heirs are wealthy, should I make a will for two-thirds?" He (peace and blessings of Allah be upon him) said, "No." I mentioned half, He (peace and blessings of Allah be upon him) said, "No." I mentioned one-third, He (peace and blessings of Allah be upon him) said, "Yes! One-third is correct, and even that is a lot."

سیدنا سعد رضی اللہ عنہ فرماتے ہیں کہ وصیت میں ایک تہائی کی مقدار نبی ﷺ نے میرے حوالے سے مقرر فرمائی تھی، آپ ﷺ میرے پاس عیادت کے لئے تشریف لائے تھے، آپ ﷺ نے مجھ سے پوچھا کہ ”کیا تم نے وصیت کر دی؟“ میں نے کہا: جی! میں نے اپنا سارا مال فقراء، مساکین اور مسافروں کے نام وقف کرنے کی وصیت کر دی ہے، فرمایا: ”ایسا نہ کرو۔“ میں نے عرض کیا کہ میرے ورثاء غنی ہیں، بہرحال! میں دوتہائی کی وصیت کر دیتا ہوں؟ فرمایا: ”نہیں۔“ میں نے نصف کا ذکر کیا، فرمایا: ”نہیں۔“ میں نے تہائی کا ذکر کیا، فرمایا: ”ہاں! ایک تہائی صحیح ہے، اور یہ بھی زیادہ ہے۔“
Sayyiduna Saad raza Allahu anhu farmate hain ki wasiyat mein ek tihaai ki miqdar Nabi (صلى الله عليه وآله وسلم) ne mere hawale se muqarrar farmai thi, aap (صلى الله عليه وآله وسلم) mere paas aiadat ke liye tashreef laaye the, aap (صلى الله عليه وآله وسلم) ne mujh se pucha ki “kya tumne wasiyat kar di?” mainne kaha: “jee! mainne apna sara maal fuqara, miskeen aur musafiroon ke naam waqf karne ki wasiyat kar di hai,” farmaya: “aisa na karo.” mainne arz kiya ki mere waris ghani hain, behrhaal! main do tihaai ki wasiyat kar deta hun? farmaya: “nahin.” mainne nisf ka zikr kiya, farmaya: “nahin.” mainne tihaai ka zikr kiya, farmaya: “haan! ek tihaai sahi hai, aur yeh bhi zyada hai.”
حَدَّثَنَا الْحُسَيْنُ بْنُ عَلِيٍّ ، عَنْ زَائِدَةَ ، عَنْ عَطَاءِ بْنِ السَّائِبِ ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ ، قَالَ: قَال سَعْدٌ فِيَّ سَنَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الثُّلُثَ: أَتَانِي يَعُودُنِي، قَالَ: فَقَالَ لِي:" أَوْصَيْتَ؟" , قَالَ: قُلْتُ: نَعَمْ , جَعَلْتُ مَالِي كُلَّهُ فِي الْفُقَرَاءِ وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ , قَالَ:" لَا تَفْعَلْ" , قُلْتُ: إِنَّ وَرَثَتِي أَغْنِيَاءُ، قُلْتُ الثُّلُثَيْنِ؟ قَالَ:" لَا" , قُلْتُ فَالشَّطْرَ؟ قَالَ:" لَا" , قُلْتُ الثُّلُثَ؟ قَالَ:" الثُّلُثُ، وَالثُّلُثُ كَثِيرٌ".
