Musnad Ahmad ibn Hanbal 23691
Harmam bin Muhaisah narrates from his father that the camel of Bura' رضي الله عنه entered a garden and caused damage. The Prophet صلی اللہ علیہ وسلم ruled that during the day, the protection of the garden is the responsibility of its owners, and if animals cause damage at night, the owner of the animal will be responsible for the loss.

حرام بن محیصہ (اپنے والد سے) نقل کرتے ہیں کہ حضرت براء رضی اللہ عنہ کی اونٹنی نے ایک باغ میں داخل ہو کر اس میں تباہی مچا دی تو نبی کریم ﷺ نے یہ فیصلہ فرمایا کہ دن کے وقت باغ کی حفاظت اس کے مالکوں کے ذمے ہے اور اگر رات کو جانور کوئی نقصان پہنچاتے ہیں تو اس نقصان کا ضامن جانور کا مالک ہوگا۔
Haram bin Muhaysa apne walid se naqal karte hain ke Hazrat Bara raziallahu anhu ki untni ne ek bagh mein dakhil hokar is mein tabahi macha di to Nabi Kareem (صلى الله عليه وآله وسلم) ne ye faisla farmaya ke din ke waqt bagh ki hifazat iske malikon ke zimme hai aur agar raat ko janwar koi nuqsan pahunchate hain to is nuqsan ka zaman janwar ka malik hoga.
حَدَّثَنَا إِسْحَاقُ هُوَ ابْنُ عِيسَى ، حَدَّثَنَا مَالِكٌ ، عَنِ الزُّهْرِيِّ ، عَنْ حَرامِ بْنِ مُحَيِّصَةَ ،" أَنَّ نَاقَةً لِلْبَرَاءِ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ، وَأَنَّ مَا أَفْسَدَتْ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا" .
