Musnad Ahmad ibn Hanbal 23694
Haram bin Muhisa (may Allah be pleased with him) narrates from his father that the Prophet (peace and blessings of Allah be upon him) gave the judgment regarding the camel of Bara' (may Allah be pleased with him) which entered a garden and caused damage, that the protection of the garden during the day is the responsibility of its owners, and if animals cause damage at night, then the owner of the animal will be responsible for the damage.

حرام بن محیصہ ﷺ (اپنے والد سے) نقل کرتے ہیں کہ حضرت براء رضی اللہ عنہ کی اونٹنی نے ایک باغ میں داخل ہو کر اس میں تباہی مچادی تو نبی کریم ﷺ نے یہ فیصلہ فرمایا کہ دن کے وقت باغ کی حفاظت اس کے مالکوں کے ذمے ہے اور اگر رات کو جانور کوئی نقصان پہنچاتے ہیں تو اس نقصان کا ضامن جانور کا مالک ہوگا۔
Haram bin Mohayisa (apne walid se) naqal karte hain ke Hazrat Bara RA ki untni ne ek bagh mein dakhil hokar is mein tabahi machadi to Nabi Kareem SAW ne ye faisla farmaya ke din ke waqt bagh ki hifazat iske malikon ke zimme hai aur agar raat ko janwar koi nuqsan pahunchate hain to is nuqsan ka zamin janwar ka malik hoga.
حَدَّثَنَا سُفْيَانُ ، قَالَ: وَسَمِعَهُ الزُّهْرِيُّ ، من سَعِيدِ بْنِ الْمُسَيَّبِ ، وَحَرَامِ بْنِ سَعْدِ بْنِ مُحَيِّصَةَ ،" أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ قَوْمٍ فَأَفْسَدَتْ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِحِفْظِ الْأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ، وَأَنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتْ بِاللَّيْلِ" ..
