Musnad Ahmad ibn Hanbal 9848
It is narrated on the authority of Abu Hurairah (may Allah be pleased with him) that whenever a funeral was brought to the Prophet (peace and blessings of Allah be upon him), he (peace and blessings of Allah be upon him) would first ask: "Was this person in debt?" If the people said yes, then the Prophet (peace and blessings of Allah be upon him) would ask: "Did he leave behind any wealth to pay it off?" If the people said yes, then the Prophet (peace and blessings of Allah be upon him) would offer his funeral prayer. But if they replied in the negative, then the Prophet (peace and blessings of Allah be upon him) would say, "You yourselves offer the funeral prayer of your companion." Then, when Allah opened the doors of conquests, the Prophet (peace and blessings of Allah be upon him) declared: "I have more right over the believers than their own selves. So, whoever dies leaving behind a debt, its repayment is my responsibility. And whoever dies leaving behind wealth, it belongs to his heirs."

حضرت ابوہریرہ رضی اللہ عنہ سے مروی ہے کہ نبی کریم ﷺ کے پاس جب کوئی جنازہ لایا جاتا تو آپ ﷺ پہلے یہ سوال پوچھتے کہ اس شخص پر کوئی قرض ہے؟ اگر لوگ کہتے جی ہاں تو نبی کریم ﷺ پوچھتے کہ اسے ادا کرنے کے لئے اس نے کچھ مال چھوڑا ہے؟ اگر لوگ کہتے جی ہاں تو نبی کریم ﷺ اس کی نماز جنازہ پڑھا دیتے اور اگر وہ ناں میں جواب دیتے تو نبی کریم ﷺ فرما دیتے کہ اپنے ساتھی کی نماز جنازہ خود ہی پڑھ لو پھر اللہ نے فتوحات کا دروازہ کھولا تو نبی کریم ﷺ نے اعلان فرما دیا کہ میں مؤمنین پر ان کی جانوں سے زیادہ حق رکھتا ہوں اس لئے جو شخص قرض چھوڑ کر جائے اس کی ادائیگی میرے ذمے ہے اور جو شخص مال چھوڑ کر جائے وہ اس کے ورثاء کا ہے۔
Hazrat Abu Huraira (رضي الله تعالى عنه) se marvi hai keh Nabi Kareem (صلى الله عليه وآله وسلم) ke paas jab koi janaza laya jata to Aap (صلى الله عليه وآله وسلم) pehle yeh sawal pochhte keh is shakhs par koi qarz hai? Agar log kehte ji haan to Nabi Kareem (صلى الله عليه وآله وسلم) poochhte keh ise ada karne ke liye usne kuch maal chhora hai? Agar log kehte ji haan to Nabi Kareem (صلى الله عليه وآله وسلم) uski namaz janaza parh dete aur agar wo na mein jawab dete to Nabi Kareem (صلى الله عليه وآله وسلم) farmate keh apne sathi ki namaz janaza khud hi parh lo phir Allah ne fatahhat ka darwaza khola to Nabi Kareem (صلى الله عليه وآله وسلم) ne elan farma diya keh mein momineen par unki jaano se zyada haq rakhta hun isliye jo shakhs qarz chhor kar jaye uski adayigi mere zimme hai aur jo shakhs maal chhor kar jaye wo uske warasa ka hai.
حَدَّثَنَا حَجَّاجٌ ، قَالَ: حَدَّثَنَا لَيْثٌ ، قَالَ: حَدَّثَنَا عُقَيْلٌ ، عَنِ ابْنِ شِهَابٍ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يُؤْتَى بِالرَّجُلِ الْمُتَوَفَّى عَلَيْهِ دَيْنٌ، فَيَسْأَلُ:" هَلْ تَرَكَ لِذَلِكَ مِنْ قَضَاءٍ؟". فَإِنْ قَالُوا: نَعَمْ، إِنَّهُ تَرَكَ وَفَاءً صَلَّى عَلَيْهِ، وَإِلَّا قَالَ لِلْمُسْلِمِينَ:" صَلُّوا عَلَى صَاحِبِكُمْ". فَلَمَّا فَتَحَ اللَّهُ عَلَيْهِ الْفُتُوحَ، قَامَ فَقَالَ: " أَنَا أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ، فَمَنْ تُوُفِّيَ مِنَ الْمُؤْمِنِينَ فَتَرَكَ دَيْنًا فَعَلَيَّ قَضَاؤُهُ، وَمَنْ تَرَكَ مَالًا فَهُوَ لِوَرَثَتِهِ" .
