Chapter on planting palm trees in land, or a man has a palm tree between rows of palm trees for another, and they disagree on its rights
باب النخل يغرس في موات، أو يكون لرجل نخلة بين ظهراني نخيل لغيره فاختلفا في حريمها
Sunan al-Kubra Bayhaqi 11864
Abu Saeed narrated that two men came to the Messenger of Allah (peace be upon him) disputing over a garden. The Prophet (peace be upon him) issued them a document. He (one of the men) cultivated it and found it to be five handspans. He (the Prophet) then fixed its surrounding boundary for him.

(١١٨٦٤) ابو سعید فرماتے ہیں کہ دو آدمی باغ کا جھگڑا لے کر رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے انھیں ایک پرچہ جاری کردیا۔ اس نے کھیتی کی تو اس کو پانچ ہاتھ پایا۔ پھر اس کو متعلقہ احاطہ مقرر کردیا۔
(11864) Abu Saeed farmate hain ki do aadmi bagh ka jhagra lekar Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas aaye. Aap ((صلى الله عليه وآله وسلم)) ne unhen ek parcha jari kar diya. Usne kheti ki to usko panch hath paya. Phir usko mutalliqa ehata muqarrar kar diya.
(11866) Narrated Ubadah bin Samit (RA): That the Messenger of Allah (ﷺ) gave a verdict in (a dispute over) one garden, two gardens, and three gardens, (the produce of which) was claimed by one man and disputed by (other) people. He (the Prophet) gave a verdict that he (the claimant) should get land equal to the produce of a branch for each palm tree.
(b) In the Marasil of Abu Dawud, it is narrated on the authority of Urwah ibn Zubair that the Messenger of Allah (ﷺ) gave a verdict in (a case concerning) a wall of date-palm trees according to the length of their branches.

(١١٨٦٦) حضرت عبادہ بن صامت (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے ایک باغ میں ، دو باغوں میں اور تین باغوں میں فیصلہ کیا ایک آدمی کے لیے تو وہ (لوگ) اس کے حقوق میں اختلاف کرتے تھے۔ آپ نے فیصلہ کیا کہ ہر کھجور سے اس کی ٹہنی کے پھل کے برابر زمین اس کے لیے ہوگا۔
(ب) مراسیلِ ابو داؤد میں عروہ بن زبیر سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے نخلستان کی دیوار میں ان کی ٹہنیوں کی لمبائی کے مطابق فیصلہ کیا۔
(11866) Hazrat Ubadah bin Samit (RA) se riwayat hai ke Rasool Allah ((صلى الله عليه وآله وسلم)) ne ek bagh mein, do baghon mein aur teen baghon mein faisla kiya ek aadmi ke liye to wo (log) us ke huqooq mein ikhtilaf karte thay. Aap ne faisla kiya ke har khajoor se us ki tehni ke phal ke barabar zameen us ke liye hoga.
(b) Marasil Abu Dawood mein Arwah bin Zabeer se manqool hai ke Rasool Allah ((صلى الله عليه وآله وسلم)) ne Nakhalistan ki deewar mein un ki tehniyon ki lambai ke mutabiq faisla kiya.
