Chapter on the permission of voluntary charity for those who are not eligible for obligatory charity from Banu Hashim and Banu Abdul-Muttalib

باب إباحة صدقة التطوع لمن لا تحل له صدقة الفرض من بني هاشم وبني عبد المطلب

Sunan al-Kubra Bayhaqi 12038

Abdullah bin Hasan, from the family of the Prophet (peace and blessings of Allah be upon him), narrated, and the narrator thinks that he is Zayd bin Ali, that Fatimah bint Rasulullah (peace and blessings of Allah be upon him) gave charity from her wealth to Banu Hashim and Banu Abdul Muttalib, and Ali (may Allah be pleased with him) gave charity to them and included other people with them.

(١٢٠٣٨) حضرت عبداللہ بن حسن اہل بیت میں سے نقل فرماتے ہیں اور راوی کے خیال میں وہ زید بن علی ہیں کہ فاطمہ بنت رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے اپنے مال کا بنی ہاشم اور بنی عبدالمطلب پر صدقہ کیا اور حضرت علی (رض) نے صدقہ کیا ان پر اور ان کے ساتھ اور لوگوں کو بھی شامل کیا۔

Hazrat Abdullah bin Hasan ehl e bait mein se naql farmate hain aur ravi ke khayal mein wo Zaid bin Ali hain ke Fatima bint Rasul Allah ((صلى الله عليه وآله وسلم)) ne apne maal ka Bani Hashim aur Bani Abdul Muttalib par sadqa kiya aur Hazrat Ali (RA) ne sadqa kiya un par aur un ke sath aur logon ko bhi shamil kiya.

١٢٠٣٨ - أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أَخْبَرَنِي مُحَمَّدُ بْنُ عَلِيِّ بْنِ شَافِعٍ، أَخْبَرَنِي عَبْدُ اللهِ بْنُ حَسَنِ بْنِ حَسَنٍ، عَنْ غَيْرِ وَاحِدٍ مِنْ أَهْلِ بَيْتِهِ،وَأَحْسِبُهُ قَالَ:زَيْدِ بْنِ عَلِيٍّ، أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ" تَصَدَّقَتْ بِمَالِهَا عَلَى بَنِي هَاشِمٍ وَبَنِي الْمُطَّلِبِ، وَأَنَّ عَلِيًّا رَضِيَ اللهُ عَنْهُ تَصَدَّقَ عَلَيْهِمْ، وَأَدْخَلَ مَعَهُمْ غَيْرَهُمْ "

Sunan al-Kubra Bayhaqi 12039

Ja'far ibn Muhammad narrated from his father that he (the father) would drink from the water tanks built on the paths between Makkah and Madinah by people. I (the narrator) said to him (Ja'far ibn Muhammad) or it was said to them (in their presence), "But it has been given to them (as charity)." They said, "Only obligatory charity has been forbidden to us."

(١٢٠٣٩) جعفر بن محمد اپنے والد سے نقل فرماتے ہیں کہ وہ راستوں میں بنائے گئے پانی کے گھاٹوں سے پانی پیتے تھے جن کو لوگوں نے مکہ اور مدینہ کے درمیان بنایا تھا، میں نے کہا : یا ان کو اس بارے میں کہا گیا تو انھوں نے کہا : ہم پر صرف فرضی صدقہ حرام کردیا گیا۔

(12039) jaafar bin muhammad apne walid se naql farmate hain ki woh raaston mein banaye gaye pani ke ghaton se pani pite the jin ko logon ne makkah aur madinah ke darmiyaan banaya tha, maine kaha : ya un ko is bare mein kaha gaya to unhon ne kaha : hum par sirf farzi sadqah haram kardiya gaya.

١٢٠٣٩ - وَبِإِسْنَادِهِ أنبأ الشَّافِعِيُّ، أنبأ إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ ⦗٣٠٤⦘ أَبِيهِ، أَنَّهُ كَانَ يَشْرَبُ مِنْ سِقَايَاتٍ كَانَ يَضَعُهَا النَّاسُ بَيْنَ مَكَّةَ وَالْمَدِينَةِ،فَقُلْتُ:أَوْ قِيلَ لَهُ،فَقَالَ:" إِنَّمَا حُرِّمَتْ عَلَيْنَا الصَّدَقَةُ الْمَفْرُوضَةُ "
