Chapter on the one who does not inherit anything from the nephew with the grandfather
باب من لم يورث ابن الأخ مع الجد شيئا
Sunan al-Kubra Bayhaqi 12319
(12319) It is narrated on the authority of Ibrahim that Ali and Ibn Mas'ud (may Allah be pleased with them) would not make the nephew an heir along with the grandfather.

(١٢٣١٩) ابراہیم سے روایت ہے کہ حضرت علی اور ابن مسعود (رض) بھتیجے کو دادے کے ساتھ وارث نہ بناتے تھے۔

١٢٣١٩ - أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ عَلِيٍّ الْحَافِظُ، أنا أَبُو إِسْحَاقَ الْأَصْبَهَانِيُّ، أنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ الْقَطَّانُ، أنا الْحَسَنُ بْنُ عِيسَى، أنا ابْنُ الْمُبَارَكِ، أنا أَبُو بَكْرِ بْنُ عَيَّاشٍ، عَنِ الْمُغِيرَةِ وَالْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، أَنَّ عَلِيًّا وَعَبْدَ اللهِ بْنَ مَسْعُودٍ" كَانَا لَا يُوَرِّثَانِ ابْنَ الْأَخِ مَعَ الْجَدِّ "
Sunan al-Kubra Bayhaqi 12320
Shabi said: "None of the people used to allow a maternal uncle or a nephew to inherit with the grandfather."

(١٢٣٢٠) شعبی فرماتے ہیں : لوگوں میں سے کوئی بھی اخیافی بھائی کو اور بھتیجے کو دادے کے ساتھ وارث نہ بناتا تھا۔
(12320) Shabi farmate hain : logon mein se koi bhi akhayafi bhai ko aur bhateeje ko dade ke sath waris na banata tha.
