Chapter on one who said: The one who holds the contract of marriage is the husband based on the waiver of the dowry
باب من قال الذي بيده عقدة النكاح الزوج من باب عفو المهر

Abu Bishr Taous, Ata and the people of Madinah narrated from them that they said: The one who has the marriage contract in his hand is the guardian. They said: I informed them of the saying of Sa'id bin Jubayr that he is the husband, so they went back on their word. When Sa'eed bin Jubayr came, they asked him: What do you think, if the guardian waives the dowry and the woman refuses, will the guardian's waiver be sufficient, or if the woman waives it and the guardian refuses, will the guardian have any say?

(١٤٤٥٣) ابو بشر طاؤس، عطاء اور اہل مدینہ سے نقل فرماتے ہیں کہ انھوں نے فرمایا : جس کے ہاتھ میں نکاح کی گرہ ہے، وہ ولی ہے۔ کہتے ہیں : میں نے ان کو سعید بن جبیر کے قول کی خبر دی کہ وہ خاوند ہے تو انھوں نے اپنے قول سے رجوع کرلیا۔ جب سعید بن جبیر آئے تو انھوں نے پوچھا : آپ کا کیا خیال ہے کہ اگر ولی حق مہر معاف کر دے اور عورت انکار کر دے تو ولی کا معاف کرنا کچھ کفایت کرے گا یا عورت معاف کرے اور ولی انکار کر دے تو ولی کا کوئی تعلق ہے ؟
Abu Bashar Taous, Ata aur ahal Madina se naqal farmate hain ki unhon ne farmaya: Jis ke hath mein nikah ki girah hai, wo wali hai. Kehte hain: Maine un ko Saeed bin Jubair ke qaul ki khabar di ki wo khawanad hai to unhon ne apne qaul se rujoo karliya. Jab Saeed bin Jubair aaye to unhon ne poocha: Aap ka kya khayal hai ki agar wali haq mehr maaf kar de aur aurat inkar kar de to wali ka maaf karna kuch kafiyat kare ga ya aurat maaf kare aur wali inkar kar de to wali ka koi taluq hai?
١٤٤٥٣ - وَأَخْبَرَنَا أَبُو نَصْرٍ، أنبأ أَبُو مَنْصُورٍ، ثنا أَحْمَدُ، ثنا سَعِيدٌ، ثنا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ طَاوُسٍ،وَعَطَاءٍ وَأَهْلِ الْمَدِينَةِ أَنَّهُمْ قَالُوا:" الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ هُوَ الْوَلِيُّ "فَأَخْبَرْتُهُمْ بِقَوْلِ سَعِيدِ بْنِ جُبَيْرٍ" هُوَ الزَّوْجُ "فَرَجَعُوا عَنْ قَوْلِهِمْ،فَلَمَّا قَدِمَ سَعِيدُ بْنُ جُبَيْرٍ قَالَ:" أَرَأَيْتُمْ إِنْ عَفَا الْوَلِيُّ وَأَبَتِ الْمَرْأَةُ مَا يُغْنِي عَفْوُ الْوَلِيِّ، أَوْ عَفَتْ هِيَ وَأَبَى الْوَلِيُّ مَا لِلْوَلِيِّ مِنْ ذَلِكَ "
