Sunan al-Kubra Bayhaqi 14473
Regarding the man who secluded himself with his wife after marriage but divorced her before consummation, Abdullah bin Abbas (may Allah be pleased with him) said that he would pay half of the dowry, as this is the command of Allah: {And if you divorce them before you have touched them, and you have already assigned them a dowry, then [give] half of what you assigned} [Al-Baqarah 237] “If you divorce them before you have touched them, and you have already assigned them a dowry, then [give] half of what you assigned.”

(١٤٤٧٣) حضرت عبداللہ بن عباس (رض) اس شخص کے بارے میں فرماتے ہیں جس نے شادی کے بعد تنہائی اختیار کی، لیکن دخول سے پہلے ہی طلاق دے دی تو وہ نصف حق مہر ادا کرے گا؛ کیونکہ یہی اللہ کا فرمان ہے : { وَ اِنْ طَلَّقْتُمُوْہُنَّ مِنْ قَبْلِ اَنْ تَمَسُّوْہُنَّ وَ قَدْ فَرَضْتُمْ لَہُنَّ فَرِیْضَۃً فَنِصْفِ مَا فَرَضْتُمْ } [البقرۃ ٢٣٧] ” اگر تم نے مجامعت سے پہلے طلاق دے دی اور حق مہر مقرر کرلیا تو نصف ادا کرنا ہے جتنا تم نے مقرر کیا ہے۔ “
Hazrat Abdullah bin Abbas (RA) iss shakhs ke bare mein farmate hain jis ne shaadi ke baad tanhai ikhtiyar ki, lekin dukhool se pehle hi talaq de di to woh nisf haq mehr ada kare ga; kyunki yahi Allah ka farman hai: {Wa in tallaqtmoohunna min qabl an tamassoohunna wa qad faradtum la-hunna fareedatan fanisfi ma faradtum} [Al-Baqarah 237] "Agar tum ne mujamaat se pehle talaq de di aur haq mehr muqarrar kar liya to nisf ada karna hai jitna tum ne muqarrar kiya hai."
١٤٤٧٣ - أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ لَيْثٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا أَنَّهُ قَالَ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ يَخْلُو بِهَا فَلَا يَمَسَّهَا ثُمَّ يُطَلِّقُهَا" لَيْسَ لَهَا إِلَّا نِصْفُ الصَّدَاقِ لِأَنَّ اللهَ تَعَالَى يَقُولُ:{وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً فَنِصْفُ مَا فَرَضْتُمْ}[البقرة: ٢٣٧]"
