Chapter: What is mentioned about banishing the slave
باب ما جاء في نفي الرقيق
Sunan al-Kubra Bayhaqi 17097
Abu Zinad narrated from the jurists of Medina that when a slave man or a slave woman commits fornication, then each one of them will receive fifty lashes. Exile is not applicable to them. They said that the one who has been subjected to this [punishment] is owned, therefore the punishment of a slave is applicable to him.

(١٧٠٩٧) ابو زناد فقہاء اہل مدینہ سے روایت کرتے ہیں کہ جب غلام یا لونڈی زنا کرلے تو ان میں سے ہر ایک پر پچاس کوڑے ہیں، جلا وطنی ان پر نہیں ہے۔ وہ کہتے ہیں کہ جو اسے پہنچا ہے وہ مملوک ہے لہٰذا اس پر غلام ہی کی حد ہے۔
Abu Zinad faqah ahl Madinah se riwayat karte hain kah jab ghulam ya laundi zina karle to un mein se har ek par pachas kore hain, jala watani un par nahin hai. Woh kahte hain kah jo ise pahuncha hai woh mamlook hai lahaza is par ghulam hi ki had hai.
١٧٠٩٧ - أَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ، أنبأ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ الْقَاضِي، ثنا ابْنُ أَبِي أُوَيْسٍ، ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ،كَانُوا يَقُولُونَ:" إِذَا زَنَى الْعَبْدُ أَوِ الْأَمَةُ فَعَلَى كُلِّ وَاحِدٍ مِنْهُمَا فَعَلَ ذَلِكَ جَلْدُ خَمْسِينَ، وَلَا تَغْرِيبَ عَلَى مَمْلُوكٍ،وَكَانُوا يَقُولُونَ:مَنْ أَصَابَ حَدًّا وَهُوَ مَمْلُوكٌ فَلَمْ يُقَمْ عَلَيْهِ حَتَّى عَتَقَ فَعَلَيْهِ حَدُّ الْمَمْلُوكِ "
