Narrated Sahl bin Abi Hathma: `Abdullah bin Sahl and Muhaiyisa bin Mas`ud bin Zaid set out to Khaibar, the inhabitants of which had a peace treaty with the Muslims at that time. They parted and later on Muhaiyisa came upon `Abdullah bin Sah! and found him murdered agitating in his blood. He buried him and returned to Medina. `Abdur Rahman bin Sahl, Muhaiyisa and Huwaiuisa, the sons of Mas`ud came to the Prophet and `Abdur Rahman intended to talk, but the Prophet said (to him), Let the eldest of you speak. as `Abdur-Rahman was the youngest:. `Abdur-Rahman kept silent and the other two spoke. The Prophet said, If you swear as to who has committed the murder, you will have the right to take your right from the murderer. They said, How should we swear if we did not witness the murder or see the murderer? The Prophet said, Then the Jews can clear themselves from the charge by taking Alaska (an oath taken by men that it was not they who committed the murder). The!y said, How should we believe in the oaths of infidels? So, the Prophet himself paid the blood money (of `Abdullah). (See Hadith No. 36 Vol. 9.)
حضرت سہل بن ابی حثمہ ؓسے روایت ہے، انھوں نے فرمایا کہ عبداللہ بن سہل اور محیصہ بن مسعود بن زید ؓخیبر کی طرف گئے جبکہ ان دنوں یہودیوں سے صلح تھی۔ وہاں پہنچ کر دونوں جداجدا ہوگئے، پھر جب محیصہؓحضرت عبداللہ بن سہل ؓ کے پاس آئے تو دیکھا کہ وہ ا پنے خون میں لت پت ہے، کسی نے ان کو قتل کرڈالا ہے۔ خیر محیصہ ؓ نے انھیں دفن کردیا۔ اسکے بعد وہ مدینہ طیبہ آئے تو عبدالرحمان بن سہل اور محیصہ، حویصہ جو مسعود کے بیٹے تھے نبی کریم ﷺ کے پاس گئے۔ عبدالرحمان نے بات کرنا چاہی تو آپ ﷺ نے فرمایا: ’’بڑے کو بات کرنے دو۔‘‘ چونکہ وہ سب سے چھوٹے تھے، اس لیے خاموش ہو گئے۔ تب حویصہ اور محیصہ نے گفتگو کی۔ آپ نے فرمایا: ’’تم قسم اٹھا کر قاتل یا ا پنے ساتھی کے خون کا استحقاق ثابت کرو گے؟‘‘ انھوں نے عرض کیا: ہم کیونکر قسم اٹھا سکتے ہیں جبکہ ہم وہاں موجود نہ تھے اور نہ ہم نہ انھیں دیکھا ہی ہےآپ نے فرمایا: ’’پھر یہودی پچاس قسمیں اٹھا کر اپنی براءت کرلیں گے۔‘‘ انھوں نے عرض کیا: وہ تو کافر ہیں ہم ان کی قسموں کا کیسے اعتبار کریں، چنانچہ نبی کریم ﷺ نے خود اپنے پاس سے ان کی دیت ادا کردی۔
Hazrat Sahl bin Abi Hathmah (Radi Allahu Anhu) se riwayat hai, unhon ne farmaya ke Abdullah bin Sahl aur Muhayyisah bin Masood bin Zaid (Radi Allahu Anhu) Khaibar ki taraf gaye jabke in dino Yahoodiyoon se sulah thi. Wahan pahonch kar dono juda juda ho gaye, phir jab Muhayyisah (Radi Allahu Anhu) Hazrat Abdullah bin Sahl (Radi Allahu Anhu) ke paas aaye to dekha ke woh apne khoon mein lath-path hai, kisi ne in ko qatal kar dala hai. Khair Muhayyisah (Radi Allahu Anhu) ne inhein dafan kar diya. Is ke baad woh Madinah Tayyibah aaye to Abdur Rahman bin Sahl aur Muhayyisah, Huwayyisah jo Masood ke bete the Nabi Kareem (Sallallahu Alaihi Wasallam) ke paas gaye. Abdur Rahman ne baat karni chahi to aap (Sallallahu Alaihi Wasallam) ne farmaya: "Bare ko baat karne do." Chunke woh sab se chhote the, is liye khamosh ho gaye. Tab Huwayyisah aur Muhayyisah ne guftagu ki. Aap ne farmaya: "Tum qasam utha kar qatil ya apne sathi ke khoon ka istahqaq sabit karoge?" Unhon ne arz kiya: Hum kiyunkar qasam utha sakte hain jabke hum wahan maujood na the aur na hum ne inhein dekha hi hai aap ne farmaya: "Phir Yahoodi pachas qasmein utha kar apni bara'at kar lein ge." Unhon ne arz kiya: Woh to kafir hain hum un ki qasmon ka kaise aitibar karein, chunancha Nabi Kareem (Sallallahu Alaihi Wasallam) ne khud apne paas se un ki diyat ada kar di.
حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا بِشْرٌ هُوَ ابْنُ الْمُفَضَّلِ ، حَدَّثَنَا يَحْيَى ، عَنْ بُشَيْرِ بْنِ يَسَارٍ ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ ، قَالَ : انْطَلَقَ عَبْدُ اللَّهِ بْنُ سَهْلٍ ومُحَيِّصَةُ بْنُ مَسْعُودِ بْنِ زَيْدٍ إِلَى خَيْبَرَ وَهِيَ يَوْمَئِذٍ صُلْحٌ فَتَفَرَّقَا ، فَأَتَى مُحَيِّصَةُ إِلَى عَبْدِ اللَّهِ بْنِ سَهْلٍ وَهُوَ يَتَشَحَّطُ فِي دَمٍ قَتِيلًا فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ ، فَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَمُحَيِّصَةُ وَحُوَيِّصَةُ ابْنَا مَسْعُودٍ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ ، فَقَالَ : كَبِّرْ كَبِّرْ وَهُوَ أَحْدَثُ الْقَوْمِ فَسَكَتَ فَتَكَلَّمَا ، فَقَالَ : أَتَحْلِفُونَ وَتَسْتَحِقُّونَ قَاتِلَكُمْ أَوْ صَاحِبَكُمْ ، قَالُوا : وَكَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ ، قَالَ : فَتُبْرِيكُمْ يَهُودُ بِخَمْسِينَ ، فَقَالُوا : كَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ كُفَّارٍ فَعَقَلَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ .
