Abu Huraira and Zaid bin Khalid (رضي الله تعال ی عنہما) narrated that a Bedouin came to the Prophet (صلى الله عليه وآله وسلم) while he (the Prophet ﷺ) was sitting, and said, ‘O Allah's Apostle ( صلى ہللاعليه و آله وسلم), give your verdict according to Allah's Laws (in our case).’ Then his opponent got up and said, ‘he has told the truth, O Allah's Apostle ( صلى الله عليه وآله وسلم). Decide his case according to Allah's Laws. My son was a laborer working for this person, and he committed illegal sexual intercourse with his wife, and the people told me that my son should be stoned to death, but I offered one-hundred sheep and a slave girl as a ransom for him. Then I asked the religious learned people, and they told me that my son should be flogged with one-hundred stripes and be exiled for one year.’ The Prophet (صلى الله عليه وآله وسلم) said, ‘by Him in Whose Hand my soul is, I will judge you according to Allah's Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you, O Unais, go to the wife of this man (and if she confesses), stone her to death.’ So Unais (رضي الله تعالى عنه) went in the morning and stoned her to death (after she had confessed).’
حضرت ابو ہریرہ رضی اللہ عنہ اور حضرت زید بن خالد رضی اللہ عنہ سے روایت ہے کہ ایک دیہاتی نبی ﷺ کی خدمت میں حاضر ہوا جبکہ آپ بیٹھے ہوئے تھے۔ اس نے عرض کی: اللہ کے رسول! (ہمارے درمیان) اللہ کی کتاب کے مطابق فیصلہ کریں اس کا مخالف کھڑا ہوا اور کہنے لگا: اللہ کے رسول! اس نے صحیح کہا ہے۔ اس کا کتاب اللہ کے مطابق فیصلہ کریں۔ بات یہ ہے کہ میرا لڑکا اس کے ملازم تھا اور اس نے اس کی بیوی سے زنا کر لیا ہے۔ لوگوں نے مجھے بتایا کہ میرے بیٹے کو رجم کیا جائے گا، چنانچہ میں نے اس سزا کے بدلے سو بکریاں اور ایک لونڈی کا فدیہ دیا۔ پھر اس نے اہل علم سے رابطہ کیا تو انہوں نے اس خیال کا اظہار کیا کہ میرے لڑکے پر سو کوڑے اور ایک سال کی جلاوطنی لازمی ہے۔ آپ ﷺ نے فرمایا: مجھے اس ذات کی قسم جس کے ہاتھ میں میری جان ہے! میں تم دونوں کا فیصلہ کتاب اللہ کے مطابق کروں گا۔ بکریاں اور کنیز تجھے واپس ملیں گی اور تمہارے لڑکے کو سو کوڑوں اور کنیز تجھے واپس ملیں گی اور تمہارے لڑکے کو سو کوڑوں اور ایک سال جلا وطنی کی سزا دی جائے گی۔ اے انیس! تم صبح اس عورت کے پاس جاؤ اور اسے رجم کرو۔ چنانچہ انیس رضی اللہ عنہ گئے اور انہوں نے اسے رجم کر دیا۔
Hazrat Abu Huraira (Radi Allahu Anhu) aur Hazrat Zaid bin Khalid (Radi Allahu Anhu) se riwayat hai ke ek dehati Nabi (Sallallahu Alaihi Wasallam) ki khidmat mein hazir hua jabke Aap baithe hue thay. Us ne arz ki: Allah ke Rasool! (Hamare darmiyan) Allah ki kitab ke mutabiq faisla karein is ka mukhalif khara hua aur kehne laga: Allah ke Rasool! Is ne sahih kaha hai. Is ka kitab Allah ke mutabiq faisla karein. Baat ye hai ke mera larka is ke mulazim tha aur us ne is ki biwi se zina kar liya hai. Logon ne mujhe bataya ke mere bete ko rajm kiya jaye ga, chunanche main ne is saza ke badle sau bakriyan aur ek laundi ka fidya diya. Phir us ne ahl-e-ilm se rabta kiya to unhone is khayal ka izhar kiya ke mere larke par sau kode aur ek saal ki jala-watni lazmi hai. Aap (Sallallahu Alaihi Wasallam) ne farmaya: Mujhe us zaat ki qasam jis ke hath mein meri jaan hai! Main tum dono ka faisla kitab Allah ke mutabiq karunga. Bakriyan aur kaneez tujhe wapas milein gi aur tumhare larke ko sau kodon aur ek saal jala watni ki saza di jaye gi. Aye Unais! Tum subah is aurat ke paas jao aur isay rajm karo. Chunanche Unais (Radi Allahu Anhu) gaye aur unhone isay rajm kar diya.
حَدَّثَنَا عَاصِمُ بْنُ عَلِيٍّ ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ ، عَنْ الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللَّهِ ، عَنْ أَبِي هُرَيْرَةَ ، وَزَيْدِ بْنِ خَالِدٍ أن رجلا من الأعراب جاء إلى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ جَالِسٌ ، فَقَالَ : يَا رَسُولَ اللَّهِ , اقْضِ بِكِتَابِ اللَّهِ ، فَقَامَ خَصْمُهُ ، فَقَالَ : صَدَقَ اقْضِ لَهُ يَا رَسُولَ اللَّهِ بِكِتَابِ اللَّهِ : إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ ، فَافْتَدَيْتُ بِمِائَةٍ مِنَ الْغَنَمِ ، وَوَلِيدَةٍ ، ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ ، فَزَعَمُوا أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ ، فَقَالَ : وَالَّذِي نَفْسِي بِيَدِهِ ، لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ ، أَمَّا الْغَنَمُ وَالْوَلِيدَةُ ، فَرَدٌّ عَلَيْكَ ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ ، وَأَمَّا أَنْتَ يَا أُنَيْسُ فَاغْدُ عَلَى امْرَأَةِ هَذَا ، فَارْجُمْهَا . فَغَدَا أُنَيْسٌ فَرَجَمَهَا .
