Sahih al-Bukhari 7260
Narrated Abu Huraira: While we were with Allah's Apostle a bedouin got up and said, O Allah's Apostle! Settle my case according to Allah's Book (Laws). Then his opponent got up and said, O Allah's Apostle! He has said the truth! Settle his case according to Allah's Book (Laws.) and allow me to speak, He said, My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile.' The Prophet said, By Him in Whose Hands my life is, I will judge between you according to Allah's Book (Laws): As for the slave girl and the sheep, they are to be returned; and as for your son, he shall receive onehundred lashes and will be exiled for one year. You, O Unais! addressing a man from Bani Aslam, Go tomorrow morning to the wife of this (man) and if she confesses, then stone her to death. The next morning Unais went to the wife and she confessed, and he stoned her to death.
سیدنا ابو ہریرہ ؓ ہی سے روایت ہے انہوں نے کہا: ایک دفعہ ہم رسول اللہ ﷺ کی خدمت میں موجود تھے کہ اچانک ایک دیہاتی کھڑا ہو اور عرض کرنے لگا: اللہ کے رسول! کتاب اللہ کے مطابق میرا فیصلہ کر دیں۔ اس کے بعد اس کا مد مقابل کھڑا ہوا اس نے بھی یہی عرض کی: اللہ کے رسول! یہ سچ کہتا ہے۔ اس کا فیصلہ اللہ کی کتاب کے مطابق فرمائیں لیکن مجھے کچھ کہنے کی اجازت دیں۔ نبی ﷺ نے اس سے فرمایا: ”بیان کرو۔“ اس نے کہا: میرا بیٹا اس شخص کے ہاں ملازم تھا۔ اس نے اس کی بیوی سے زنا کر لیا۔ لوگوں نے مجھے بتایا کہ میرے بیٹے کو رجم کی سزا ملے گی لیکن میں نے اس کی طرف سے سو بکریاں اور ایک لونڈی بطور فدیہ ادا کریں۔ پھر میں نے اہل علم سے رابطہ کیا تو انہوں نے مجھے بتایا کہ اس کی بیوی پر رجم اور میرے بیٹے پر سو کوڑے اور ایک سال کے لیے جلاوطنی کی سزا ہے۔ آپ ﷺ نےفرمایا: اس ذات کی قسم جس کے ہاتھ میں میری جان ہے! میں تمہارے درمیان اللہ کی کتاب کے مطابق فیصلہ کروں گا۔ لونڈی اور بکریاں (تجھے) واپس کر دی جائیں اور تیرے بیٹے پر سو کوڑے اور ایک سال جلاوطنی واجب ہے، پھر قبیلہ اسلم کے ایک آدمی سیدنا انیس ؓ سے کہا: اے انیس! تم اس کی بیوی کے پاس جاؤ، اگر وہ زنا کا اعتراف کرلے تو اسے رجم کر دو۔ چنانچہ انیس ؓ ان کے پاس گئے اور اس نے اقرار کر لیا اس کے بعد سیدنا انیس ؓ نے اسے سنگسار کر ڈالا۔
Sayyiduna Abu Hurairah (Radi Allahu Anhu) hi se riwayat hai unhone kaha: Ek dafa hum Rasool Allah (Sallallahu Alaihi Wasallam) ki khidmat mein maujood thay ke achanak ek dehati khara ho aur arz karne laga: Allah ke Rasool! Kitabullah ke mutabiq mera faisla kar dein. Is ke baad is ka mud-e-muqabil khara hua us ne bhi yehi arz ki: Allah ke Rasool! Yeh sach kehta hai. Is ka faisla Allah ki kitab ke mutabiq farmaein lekin mujhe kuch kehne ki ijazat dein. Nabi (Sallallahu Alaihi Wasallam) ne us se farmaya: ''Bayan karo.'' Us ne kaha: Mera beta is shakhs ke haan mulazim tha. Us ne is ki biwi se zina kar liya. Logon ne mujhe bataya ke mere bete ko rajm ki saza milay gi lekin main ne is ki taraf se so bakrian aur ek laundi bator-e-fidya ada kein. Phir main ne ahl-e-ilm se rabta kiya to unhone mujhe bataya ke is ki biwi par rajm aur mere bete par so koray aur ek saal ke liye jila-watni ki saza hai. Aap (Sallallahu Alaihi Wasallam) ne farmaya: Us zaat ki qasam jis ke hath mein meri jaan hai! Main tumhare darmiyan Allah ki kitab ke mutabiq faisla karoon ga. Laundi aur bakrian (tujhe) wapas kar di jayein aur tere bete par so koray aur ek saal jila-watni wajib hai, phir qabila-e-Aslam ke ek aadmi Sayyiduna Unais (Radi Allahu Anhu) se kaha: Ay Unais! Tum is ki biwi ke paas jao, agar woh zina ka aitraf kar le to isay rajm kar do. Chunanche Unais (Radi Allahu Anhu) un ke paas gaye aur us ne iqrar kar liya us ke baad Sayyiduna Unais (Radi Allahu Anhu) ne isay sangsar kar dala.
وحَدَّثَنَا أَبُو الْيَمَانِ ، أَخْبَرَنَا شُعَيْبٌ ، عَنْ الزُّهْرِيِّ أَخْبَرَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ ، أَنَّ أَبَا هُرَيْرَةَ قَالَ : بَيْنَمَا نَحْنُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ قَامَ رَجُلٌ مِنَ الْأَعْرَابِ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، اقْضِ لِي بِكِتَابِ اللَّهِ ، فَقَامَ خَصْمُهُ ، فَقَالَ : صَدَقَ يَا رَسُولَ اللَّهِ ، اقْضِ لَهُ بِكِتَابِ اللَّهِ وَأْذَنْ لِي ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قُلْ : فَقَالَ : إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَالْعَسِيفُ الْأَجِيرُ فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي ، أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةٍ مِنَ الْغَنَمِ وَوَلِيدَةٍ ، ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي ، أَنَّ عَلَى امْرَأَتِهِ الرَّجْمَ ، وَأَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ ، فَقَالَ : وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ ، أَمَّا الْوَلِيدَةُ وَالْغَنَمُ فَرُدُّوهَا ، وَأَمَّا ابْنُكَ فَعَلَيْهِ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ ، وَأَمَّا أَنْتَ يَا أُنَيْسُ لِرَجُلٍ مِنْ أَسْلَمَ فَاغْدُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا ، فَغَدَا عَلَيْهَا أُنَيْسٌ فَاعْتَرَفَتْ فَرَجَمَهَا .
