Suhaim bin Yazid al-Hamrawi reported that a man died and left no heir. They wrote about it to Umar bin Abd al-Aziz, may Allah have mercy on him, who was the Caliph at the time. He replied that his inheritance should be given to those who used to perform the duty of prayer with him. So they divided his inheritance among those who used to perform the duty of prayer with him, under his supervision.

سہم بن یزید حمراوی نے خبر دی کہ ایک آدمی مر گیا اور اس نے کوئی وارث نہ چھوڑا، انہوں نے اس بارے میں عمر بن عبدالعزیز رحمہ اللہ کو لکھا جو اس وقت خلیفہ تھے، انہوں نے جواب دیا کہ اس کی میراث اس کو دی جائے جو اس کے ساتھ وظیفہ لیتے تھے، چنانچہ انہوں نے اپنی نگرانی میں اس کی میراث ان کے درمیان تقسیم کر دی جو اس کے ساتھ وظیفہ لیتے تھے۔

(حديث مقطوع) حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ، حَدَّثَنَا حَيْوَةُ، أَخْبَرَنِي سَهْمُ بْنُ يَزِيدَ الْحَمْرَاوِيُّ:"أَنَّ رَجُلًا تُوُفِّيَ وَلَيْسَ لَهُ وَارِثٌ، فَكُتِبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَهُوَ خَلِيفَةٌ، فَكَتَبَ: أَنْ اقْتَسِمُوا مِيرَاثَهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ، فَقُسِمَ مِيرَاثُهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ فِي عِرَافَتِهِ".
