Ubadah bin Samit (رضي الله تعالى عنه) narrated that the Apostle of Allah ( صلى الله عليه وآله وسلم) ruled concerning one, two or three date palms belonging to a man among other palm trees, when they differ concerning entitlement to the surrounding land. He ruled that the land around each of those trees, as far as their leaves reach, measured from the bottom of the tree, belongs to the owner of the tree.

عبادہ بن صامت رضی اللہ عنہ سے روایت ہے کہ باغ میں کسی شخص کے ایک یا دو یا تین درخت ہوں، پھر لوگ اختلاف کریں کہ کتنی زمین پر ان کا حق ہے؟ تو اس بارے میں رسول اللہ ﷺ نے فیصلہ کیا: ہر درخت کے لیے نیچے کی اتنی زمین ہے جہاں تک اس کی ڈالیاں پھیلی ہیں، وہی اس درخت کی چوحدی ہے ۔
Abadah bin Samit (رضي الله تعالى عنه) se riwayat hai ke bagh mein kisi shakhs ke ek ya do ya teen darakht hon, phir log ikhtilaf karen ke kitni zamin par un ka haq hai? To is bare mein Rasool Allah (صلى الله عليه وآله وسلم) ne faisla kiya: Har darakht ke liye niche ki itni zamin hai jahan tak us ki dalian pheli hain, wahi us darakht ki chauhdi hai.
حَدَّثَنَا عَبْدُ رَبِّهِ بْنُ خَالِدٍ النُّمَيْرِيُّ أَبُو الْمُغَلِّسِ، حَدَّثَنَا الْفُضَيْلُ بْنُ سُلَيْمَانَ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ، أَخْبَرَنِيإِسْحَاق بْنُ يَحْيَى بْنِ الْوَلِيدِ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: قَضَى فِي النَّخْلَةِ وَالنَّخْلَتَيْنِ وَالثَّلَاثَةِ لِلرَّجُلِ فِي النَّخْلِ فَيَخْتَلِفُونَ فِي حُقُوقِ ذَلِكَ فَقَضَى أَنَّ لِكُلِّ نَخْلَةٍ مِنْ أُولَئِكَ مِنَ الْأَسْفَلِ مَبْلَغُ جَرِيدِهَا حَرِيمٌ لَهَا .
