Mustadrak Al Hakim 7982
Kharija bin Zaid bin Thabit (may Allah be pleased with him) narrates about his father that when Umar bin Khattab (may Allah be pleased with him) consulted the Companions (may Allah be pleased with them) regarding the inheritance of grandfathers and brothers, Zaid (may Allah be pleased with him) said: "My opinion is that the brother is more deserving of inheritance than the grandfather." However, Umar's (may Allah be pleased with him) stance was that the grandfather is more deserving of his grandson's inheritance than the deceased's brothers. Zaid (may Allah be pleased with him) says: "I debated with Umar (may Allah be pleased with him) and presented him with an example in this regard. Ali ibn Abi Talib (may Allah be pleased with him) and Abdullah bin Abbas (may Allah be pleased with them both) also presented examples to Umar (may Allah be pleased with him) that day and explained the multiplications and divisions according to the laws of Zaid." ** This Hadith is Sahih (authentic) according to the criteria of Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) but the two Sheikhs (may Allah have mercy on them both) did not narrate it.
" حضرت خارجہ بن زید بن ثابت رضی اللہ عنہ اپنے والد کے بارے میں فرماتے ہیں کہ حضرت عمر بن خطاب رضی اللہ عنہ نے جب صحابہ کرام رضی اللہ عنہم سے دادا اور بھائیوں کی وراثت کے سلسلے میں مشورہ کیا تو حضرت زید رضی اللہ عنہ نے کہا : میری رائے یہ ہے کہ بھائی ، دادا کی بہ نسبت وراثت کا زیادہ حقدار ہے ، جبکہ حضرت عمر رضی اللہ عنہ کا موقف یہ تھا کہ دادا اپنے پوتے کی وراثت کا میت کے بھائیوں سے زیادہ مستحق ہے ۔ حضرت زید رضی اللہ عنہ فرماتے ہیں : میں نے حضرت عمر رضی اللہ عنہ سے بحث کی ، اور اس سلسلہ میں ان کو ایک مثال سنائی ۔ حضرت علی بن ابی طالب رضی اللہ عنہ اور حضرت عبداللہ بن عباس رضی اللہ عنہما نے بھی اس دن حضرت عمر رضی اللہ عنہ کو مثال دی ، اور حضرت زید کے قوانین کے مطابق ضربیں اور تقسیمیں بیان کیں ۔ ٭٭ یہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین رحمۃ اللہ علیہما نے اس کو نقل نہیں کیا ۔"
Hazrat Khareja bin Zaid bin Sabit (رضي الله تعالى عنه) apne walid ke bare mein farmate hain ke Hazrat Umar bin Khattab (رضي الله تعالى عنه) ne jab Sahaba Kiram (رضي الله تعالى عنه) se dada aur bhaiyon ki wirasat ke silsile mein mashwara kiya to Hazrat Zaid (رضي الله تعالى عنه) ne kaha : meri rai ye hai ke bhai, dada ki ba nisbat wirasat ka ziada haqdar hai, jabke Hazrat Umar (رضي الله تعالى عنه) ka mauqif ye tha ke dada apne pote ki wirasat ka mait ke bhaiyon se ziada mustahiq hai. Hazrat Zaid (رضي الله تعالى عنه) farmate hain : main ne Hazrat Umar (رضي الله تعالى عنه) se behas ki, aur is silsile mein un ko ek misal sunai. Hazrat Ali bin Abi Talib (رضي الله تعالى عنه) aur Hazrat Abdullah bin Abbas ( (رضي الله تعالى عنه) a ne bhi is din Hazrat Umar (رضي الله تعالى عنه) ko misal di, aur Hazrat Zaid ke qawaneen ke mutabiq zarben aur taqsimen bayan kin. ** Ye hadees Imam Bukhari Rahmatullahi Alaih aur Imam Muslim Rahmatullahi Alaih ke miyaar ke mutabiq sahih hai lekin Sheikhain Rahmatullahi Alaihima ne is ko naql nahin kiya.
حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا بَحْرُ بْنُ نَصْرٍ، ثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ، عَنْ أَبِيهِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ لَمَّا اسْتَشَارَهُمْ فِي مِيرَاثِ الْجَدِّ وَالْإِخْوَةِ قَالَ زَيْدٌ: «وَكَانَ رَأْيِي أَنَّ الْإِخْوَةَ أَوْلَى بِالْمِيرَاثِ مِنَ الْجَدِّ، وَكَانَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ يَرَى يَوْمَئِذٍ أَنَّ الْجَدَّ أَوْلَى بِمِيرَاثِ ابْنِ أَبِيهِ مِنْ إِخْوَتِهِ» قَالَ زَيْدٌ: «فَحَاوَرْتُ أَنَا عُمَرَ فَضَرَبْتُ لِعُمَرَ فِي ذَلِكَ مَثَلًا وَضَرَبَ عَلِيُّ بْنُ أَبِي طَالِبٍ وَعَبْدُ اللَّهِ بْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمْ لِعُمَرَ مَثَلًا يَوْمَئِذٍ السَّيْلَ يَضْرِبَانِهِ وَيَصْرِفَانِهِ عَلَى نَحْوِ تَصْرِيفِ زَيْدٍ» هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ "" [التعليق - من تلخيص الذهبي] 7982 - على شرط البخاري ومسلم
