Chapter: The Concession Allowing A Muhrim To Marry

باب الرُّخْصَةِ فِي نِكَاحِ الْمُحْرِمِ ‏.‏

Sunan an-Nasa'i 3271

Ummul Momineen Aishah ( رضي الله تعالى عنها) narrated that a girl came to her and said, 'my father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said, 'sit here until the Prophet (صلى الله عليه وآله وسلم) comes.' Then the Apostle of Allah (صلى الله عليه وآله وسلم) came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said, 'O Apostle of Allah (صلى الله عليه وآله وسلم), I accept what my father did, but I wanted to know whether women have any say in the matter.'

عبداللہ بن عباس رضی الله عنہما کہتے ہیں کہ رسول اللہ ﷺ نے میمونہ بنت حارث رضی اللہ عنہا سے اس وقت شادی کی جب کہ آپ احرام باندھے ہوئے تھے ۱؎، اور یعلیٰ ( راوی ) کی حدیث میں «سرف» کا بھی ذکر ہے ۲؎۔

Abdul'lah ibn Abbas ( (رضي الله تعالى عنه) a kehte hain ke Rasool Allah Sallallahu Alaihi wa Sallam ne Maimuna bint Harith ( (رضي الله تعالى عنه) ا) se us waqt shadi ki jab ke aap ihram bandhe hue the 1, aur Ya'li ( rawi ) ki hadith mein 'Saraf' ka bhi zikr hai 2.

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ، عَنْ مُحَمَّدِ بْنِ سَوَاءٍ، قَالَ حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، وَيَعْلَى بْنِ حَكِيمٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ تَزَوَّجَ رَسُولُ اللَّهِ صلى الله عليه وسلم مَيْمُونَةَ بِنْتَ الْحَارِثِ وَهُوَ مُحْرِمٌ وَفِي حَدِيثِ يَعْلَى بِسَرِفَ ‏.‏

Sunan an-Nasa'i 3272

Abu Hurairah (رضي الله تعالى عنه) narrated that the Apostle of Allah (صلى الله عليه وآله وسلم) said, 'an orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses, then she is not to be forced.'


Grade: Da'if

عبداللہ بن عباس رضی الله عنہما نے خبر دی ہے کہ رسول اللہ ﷺ نے ام المؤمنین میمونہ رضی اللہ عنہا سے حالت احرام میں شادی کی۔

Abdul-Allah bin Abbas ( (رضي الله تعالى عنه) a ne khabar di hai ke Rasool-Allah salla-Allahu alaihi wa sallam ne Umm-ul-Momineen Maimoona radi-Allahu anha se haalat e ihram mein shaadi ki.

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرٍو، عَنْ أَبِي الشَّعْثَاءِ، أَنَّ ابْنَ عَبَّاسٍ، أَخْبَرَهُ أَنَّ النَّبِيَّ صلى الله عليه وسلم تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ ‏.‏

Sunan an-Nasa'i 3273

Ibn Abbas (رضي الله تعالى عنه) narrated that the Apostle of Allah married Maimunah bint Al-Harith (رضي الله تعالى عنها) when he was a Muhrim.’ According to the Hadith of Ya'la (one of the narrators said) ‘in Sarif.

عبداللہ بن عباس رضی الله عنہما سے روایت ہے کہ نبی اکرم ﷺ نے ام المؤمنین میمونہ رضی اللہ عنہا سے شادی کی، اور آپ اس وقت احرام میں تھے، میمونہ رضی اللہ عنہا نے اپنا معاملہ عباس رضی اللہ عنہما کے سپرد کر رکھا تھا تو انہوں نے ان کی شادی آپ ﷺ کے ساتھ کر دی۔

Abdul'llah bin Abbas ( (رضي الله تعالى عنه) a se riwayat hai ke Nabi-e-Akram Sallallahu Alaihi wa Sallam ne Ummul Momineen Maimuna ( (رضي الله تعالى عنه) ا) se shaadi ki, aur aap is waqt ihram mein the, Maimuna ( (رضي الله تعالى عنه) ا) ne apna mamla Abbas ( (رضي الله تعالى عنه) a ke spurd kar rakha tha to unhon ne un ki shaadi aap Sallallahu Alaihi wa Sallam ke sath kar di.

أَخْبَرَنَا عُثْمَانُ بْنُ عَبْدِ اللَّهِ، قَالَ حَدَّثَنِي إِبْرَاهِيمُ بْنُ الْحَجَّاجِ، قَالَ حَدَّثَنَا وُهَيْبٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم نَكَحَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ جَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَأَنْكَحَهَا إِيَّاهُ ‏.‏

Sunan an-Nasa'i 3274

Abu Ash-Sha'tha narrated that Ibn 'Abbas (رضي الله تعالى عنه) told him, the Prophet ( صلى الله عليه وآله وسلم) married Maimunah (رضي الله تعالى عنها) when he was a Muhrim.’

أَخْبَرَنَا أَحْمَدُ بْنُ نَصْرٍ، قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ، - وَهُوَ ابْنُ مُوسَى - عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ ‏.‏
