Chapter: Invalidating Bequests To Heirs

باب إِبْطَالِ الْوَصِيَّةِ لِلْوَارِثِ

Sunan an-Nasa'i 3641

It was narrated that Abu Hurairah said: A man came to the Prophet and said: 'O Messenger of Allah, what kind of charity brings the greatest reward?' He said: 'To give in charity when you are healthy and feeling miserly, and fearing poverty and hoping for a long life. Do not wait until the (death rattle) reaches the throat and then say: This is for so and so, and it nearly became the property of so and so (the heirs).'


Grade: Sahih

عمرو بن خارجہ رضی اللہ عنہ کہتے ہیں کہ رسول اللہ ﷺ نے خطبہ دیا تو فرمایا: ”اللہ تعالیٰ نے ہر حق والے کو اس کا حق دے دیا ہے ( تو تم سمجھ لو ) وارث کے لیے وصیت نہیں ہے“ ۔

Amro bin Khaarijah (رضي الله تعالى عنه) kehte hain ke Rasulullah (صلى الله عليه وآله وسلم) ne khutbah diya to farmaaya: “Allah Ta'ala ne har haq waale ko us ka haq de diya hai ( to tum samjh lo ) waarith ke liye wasiyat nahin hai“

أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، قَالَ حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ قَتَادَةَ، عَنْ شَهْرِ بْنِ حَوْشَبٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، عَنْ عَمْرِو بْنِ خَارِجَةَ، قَالَ خَطَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏"‏ إِنَّ اللَّهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ وَلاَ وَصِيَّةَ لِوَارِثٍ ‏"‏‏.‏

Sunan an-Nasa'i 3642

It was narrated that 'Abdullah said: The Messenger of Allah said: 'For whom among you is the wealth of his heirs dearer to him than his own wealth?' They said: 'O Messenger of Allah, there is no one among us for whom his own wealth is not dearer to him than the wealth of his heirs.' The Messenger of Allah said: 'Know that there is no one among you for whom the wealth of his heirs is not dearer than his own wealth. Your wealth is that which you have sent on ahead, and the wealth of your heirs is that which you have kept.'


Grade: Sahih

عمرو بن خارجہ رضی الله عنہ نے ذکر کیا کہ وہ رسول اللہ ﷺ کے اس خطبہ میں موجود تھے جو آپ اپنی سواری پر بیٹھ کر دے رہے تھے، سواری جگالی کر رہی تھی اور اس کا لعاب بہہ رہا تھا۔ رسول اللہ ﷺ نے اپنے خطبہ میں فرمایا: ”اللہ تعالیٰ نے میراث سے ہر انسان کا حصہ تقسیم فرما دیا ہے تو کسی وارث کے لیے وصیت کرنا درست اور جائز نہیں ہے“۔

Amr bin Kharaj (رضي الله تعالى عنه) ne zikr kiya ke woh Rasoolullah (صلى الله عليه وآله وسلم) ke is khutba mein maujood the jo aap apni sawari per baith kar de rahe the, sawari jagali kar rahi thi aur is ka laab bahh raha tha. Rasoolullah (صلى الله عليه وآله وسلم) ne apne khutba mein farmaya: "Allah Ta'ala ne miras se har insan ka hissa taqseem farma diya hai to kisi waris ke liye wasiyat karna durust aur jaiz nahi hai".

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ، قَالَ حَدَّثَنَا خَالِدٌ، قَالَ حَدَّثَنَا سَعِيدٌ، قَالَ حَدَّثَنَا قَتَادَةُ، عَنْ شَهْرِ بْنِ حَوْشَبٍ، أَنَّ ابْنَ غَنْمٍ، ذَكَرَ أَنَّ ابْنَ خَارِجَةَ، ذَكَرَ لَهُ أَنَّهُ شَهِدَ رَسُولَ اللَّهِ صلى الله عليه وسلم يَخْطُبُ النَّاسَ عَلَى رَاحِلَتِهِ وَإِنَّهَا لَتَقْصَعُ بِجِرَّتِهَا وَإِنَّ لُعَابَهَا لَيَسِيلُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم فِي خُطْبَتِهِ ‏"‏ إِنَّ اللَّهَ قَدْ قَسَّمَ لِكُلِّ إِنْسَانٍ قِسْمَهُ مِنَ الْمِيرَاثِ فَلاَ تَجُوزُ لِوَارِثٍ وَصِيَّةٌ ‏"‏‏.‏

Sunan an-Nasa'i 3643

It was narrated from Mutarrif, from his father, that the Prophet said: The mutual rivalry (for piling up of worldly things) diverts you, 'Until you visit the graves (i.e. till you die).' The son of Adam says: 'My wealth, my wealth,' but your wealth is what you eat and consume, or what you wear and it wears out, or what you give in charity and send on ahead (for the Hereafter).'


Grade: Sahih

عمرو بن خارجہ رضی الله عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”اللہ عزوجل نے ہر صاحب حق کو اس کا حق دے دیا ہے، اور کسی وارث کے لیے وصیت جائز نہیں ہے“۔

Amro bin Kharijah (رضي الله تعالى عنه) kehte hain ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Allah Azzawajal ne har sahib haq ko us ka haq de dia hai, aur kisi waris ke liye wasiyat jaiz nahin hai".

أَخْبَرَنَا عُتْبَةُ بْنُ عَبْدِ اللَّهِ الْمَرْوَزِيُّ، قَالَ أَنْبَأَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، قَالَ أَنْبَأَنَا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنْ قَتَادَةَ، عَنْ عَمْرِو بْنِ خَارِجَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ اللَّهَ عَزَّ اسْمُهُ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ وَلاَ وَصِيَّةَ لِوَارِثٍ ‏"‏‏.‏
