باب ذِكْرِ الاِخْتِلاَفِ عَلَى الزُّهْرِيِّ فِيهِ
Sunan an-Nasa'i 3740
Al-Awza'i narrated from Az-Zuhri, from 'Urwah, from Jabir, who said:"The Messenger of Allah said: 'Whoever is given something on the basis of 'Umra, it belongs to him and to his descendants, and is inherited by those who inherit from him.'"

جابر رضی الله عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”جس شخص کو کوئی چیز عمر بھر کے لیے دی گئی تو وہ چیز اسی کی ہو گی اور اس کی اولاد کی ہو گی، اس کی اولاد میں سے جو اس کے وارث ہوں گے، وہی اس کے بھی وارث ہوں گے“۔
Jabir (رضي الله تعالى عنه) kehte hain ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: “Jis shakhs ko koi cheez umr bhar ke liye di gayi to woh cheez usi ki hogi aur us ki aulad ki hogi, us ki aulad mein se jo us ke waris honge, wahi us ke bhi waris honge”.
(A different chain) from Abu 'Amr, from Ibn Shihab, from Abu Salamah, from Jabir, who said:"The Messenger of Allah said: 'Umra (a lifelong gift) belongs to the one to whom it was given; it belongs to him and to his heirs, and is inherited by those among his descendants who inherit from him.'"

جابر رضی الله عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”عمریٰ اس شخص کا ہے جس کے لیے عمریٰ کیا گیا، پھر اس کے بعد اس کی اولاد کا ہے، اس کی اولاد میں سے جو اس کے وارث ہوں گے وہی اس چیز کے بھی وارث ہوں گے“ ۔
Jabir (رضي الله تعالى عنه) kehte hain ke Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: "Umri is shakhs ka hai jis ke liye umri kiya gaya, phir uske baad uski aulad ka hai, uski aulad mein se jo uske waris honge wahi us chez ke bhi waris honge"
(A different chain) from Al-Awza'i, from Az-Zuhri, from 'Urwah and Abu Salamah, from Jabir, who said:"The Messenger of Allah said: 'Umra (a lifelong gift) belongs to the one to whom it was given; it belongs to him and to his descendants, and is inherited by those who inherit from him.'"

جابر رضی الله عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”عمریٰ اس کا ہے جس کے لیے عمریٰ کیا گیا، یہ ( زندگی بھر ) اس کا رہے گا، اور ( مرنے کے بعد ) اس کی اولاد کا ہو گا، اس کی اولاد میں سے جو اس کے وارث ہوں گے وہی اس کے وارث ہوں گے“۔
Jaber (رضي الله تعالى عنه) kehte hain ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Umri is ka hai jis ke liye umri kiya gaya, yeh (zindagi bhar) is ka rahe ga, aur (marne ke baad) is ki aulad ka ho ga, is ki aulad mein se jo is ke waris honge wahi is ke waris honge".
It was narrated from Hisham bin 'Urwah, from his father, from 'Abdullah bin Az-Zubair, that the Messenger of Allah said:"Any man who gives a lifelong gift to another man, it belongs to him (the recipient) and to his descendants, and to those who inherit from him."

عبداللہ بن زبیر رضی الله عنہما سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”جس آدمی نے کسی آدمی کو یہ کہہ کر کوئی چیز عمریٰ کی کہ یہ اس کی ہے، اور اس کے اولاد کی ہے تو وہ اس کی ہو گی، اور اس کے مرنے کے بعد اس کی اولاد میں سے جو اس کا وارث ہو گا اس کی ہو گی“۔
Abdul-Allah ibn Zubair ( (رضي الله تعالى عنه) a se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Jis aadmi ne kisi aadmi ko yeh kehh kar koi cheez umri ki ke yeh is ki hai, aur is ki aulad ki hai to woh is ki hogi, aur is ke marne ke baad is ki aulad mein se jo is ka waris hoga is ki hogi".
Al-Laith narrated from Ibn Shihab, from Abu Salamah bin 'Abdur-Rahman, from Jabir, who said:"I heard the Messenger of Allah say: 'Whoever gives a life-long gift to a man, it belongs to him and to his heirs; his words (when he gave the gift) put an end to his rights over it, and it belongs to the one to whom it was given on the basis of 'Umra, and to his heirs.'"

جابر رضی الله عنہ کہتے ہیں کہ میں نے رسول اللہ ﷺ کو فرماتے ہوئے سنا ہے: ”جس نے کوئی چیز یہ کہہ کر عمریٰ کی کہ یہ اس کی ہے اور اس کی اولاد کی ہے تو اس کی اس بات نے اس کے حق کو کاٹ دیا، یعنی ہمیشہ کے لیے اس کا حق ختم ہو گیا، اب وہ چیز ہمیشہ کے لیے اس کی ہو گی جس کو عمریٰ میں دی گئی ہے، اور اس کے مرنے کے بعد اس کی اولاد کی ہو گی“۔
Jabir (رضي الله تعالى عنه) kehte hain ke main ne Rasool Allah (صلى الله عليه وآله وسلم) ko farmate hue suna hai: "Jis ne koi cheez yeh kehk kar umri ki ke yeh is ki hai aur is ki aulad ki hai to is ki is baat ne is ke haq ko kaat diya, yani hamesha ke liye is ka haq khatam ho gaya, ab woh cheez hamesha ke liye is ki hogi jis ko umri mein di gai hai, aur is ke marne ke baad is ki aulad ki hogi".
Malik narrated from Ibn Shihab, from Abu Salamah, from Jabir that the Messenger of Allah said:"Any man who is given a gift on the basis of 'Umra, it belongs to him and to his descendants. It belongs to the one to whom he gave it, and it cannot be taken back by the one who gave it, because he has given a gift, and it comes to the heirs of the one to whom it was given."

جابر رضی الله عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”جس شخص کو کوئی چیز اس کی عمر بھر کے لیے اور اس کے بعد اس کے وارث کو دی گئی تو وہ چیز اسی کی ہو جائے گی جسے دی گئی ہے، دینے والے کو واپس نہ ہو گی کیونکہ اس نے ایسی چیز دی ہے جس میں وراثت کا قانون جاری ہو گا“۔
Jaber (رضي الله تعالى عنه) se Riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne Farmaya: "Jis shakhs ko koi cheez us ki umr bhar ke liye aur us ke baad us ke waris ko di gayi to woh cheez usi ki ho jayegi jis ko di gayi hai, dene wale ko wapas na hogi kyunke us ne aisi cheez di hai jis mein mirasat ka qanoon jari hoga".
Shua'ib narrated from Az-Zuhri, who said:"Abu Salamah bin 'Abdur-Rahman narrated to me, that Jabir told him: 'The Messenger of Allah ruled that whoever gives a lifelong gift to a man, it belongs to him and to his heirs. It belongs to the one to whom it was given, on the basis of 'Umra. It will be inherited from its recipient according to Allah's (injunctions on) inheritance and its rights.'"

جابر رضی الله عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فیصلہ کیا کہ جس شخص نے کسی کو کوئی چیز یہ کہہ کر عمریٰ کیا کہ اس کا اور اس کی اولاد کا ہے تو یہ اسی کا ہو گا جسے اس نے عمریٰ کیا ہے، اور اس کے ساتھی سے جسے اس نے دیا ہے اللہ کے مقرر کئے ہوئے حصوں اور اس کے حق کے مطابق اس کے ورثاء وارث ہوں گے ( دینے والے کو کچھ نہیں لوٹے گا ) ۔
Jabir (رضي الله تعالى عنه) se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne faisala kiya ke jis shakhs ne kisi ko koi cheez yeh keh kar umri kiya ke is ka aur is ki aulad ka hai to yeh usi ka ho ga jisay is ne umri kiya hai, aur is ke sathi se jisay is ne diya hai Allah ke muqarrar kiye hue hisson aur is ke haq ke mutaabiq is ke warsa waris honge ( dene wale ko kuchh nahin lutega ) .
Ibn Abi Dhi'b narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled -concerning a person who has been given a lifelong gift ('Umra)- that it belongs to him and to his descendants:"It is undoubtedly his, and it is not permissible for the giver to stipulate any conditions or exceptions." Abu Salamah said: "Because he gave it as a gift and thus, it is subject to the same ruling as the estate, and the condition (that it will revert to the giver on the death of recipient) has become invalid."

جابر رضی الله عنہ سے روایت ہے کہ رسول اللہ ﷺ نے اس شخص کے بارے میں جسے کوئی چیز عمری کی گئی ہو کہ یہ اس کا اور اس کی اولاد کا ہے فیصلہ صادر فرمایا کہ دینے والے کو اس میں کوئی شرط لگانا اور کوئی استثناء کرنا جائز و درست نہیں ہے۔ ابوسلمہ کہتے ہیں: اس نے ایسا عطیہ دیا ہے جس میں میراث کا قانون ہو گیا اور اس کی شرط کو باطل کر دیا ( یعنی وہ شرط لغو قرار دے دی ) ۔
Jabir (رضي الله تعالى عنه) se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne is shakhs ke bare mein jise koi cheez umri ki gai ho ke yeh is ka aur is ki aulad ka hai faisla sadar farmaaya ke dene wale ko is mein koi shart lagana aur koi istisna karna jaiz o durust nahi hai. Abuslama kehte hain: Is ne aisa atiya diya hai jis mein miras ka qanoon ho gaya aur is ki shart ko batil kar diya ( yani woh shart lugh o karar de di ) .
Salih narrated from Ibn Shihab, that Abu Salamah informed him from Jabir, that the Messenger of Allah said:"Any man who gives a lifelong gift to another man, it belongs to him (the recipient) and his descendants. He said: 'I have given it to you and to your descendants so long as any of you are still alive.' So it belongs to the one to whom it was given, and it cannot revert to the first owner, since he has given it as a gift, and as such, it becomes subject to the same ruling as the estate."

جابر رضی الله عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”جس نے کسی شخص اور اس کی اولاد کو عمریٰ کیا اور کہا کہ میں نے اسے تم کو اور تمہاری اولاد کو دے دیا ہے جب تک کہ کوئی بھی ان میں سے زندہ رہے، تو وہ چیز اسی کی ہو جائے گی جسے وہ چیز دی گئی ہے، اب وہ چیز دینے والے کو واپس نہیں ہو سکتی، اس لیے کہ اس نے اسے دیا ہی اس انداز سے ہے کہ اس میں میراث نافذ ہو گی“۔
Jaber (رضي الله تعالى عنه) se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Jis ne kisi shakhs aur us ki aulad ko umri kiya aur kaha ke main ne use tum ko aur tumhari aulad ko de diya hai jab tak ke koi bhi in mein se zinda rahe, to woh cheez usi ki ho jayegi jis se woh cheez di gai hai, ab woh cheez dene wale ko wapas nahin ho sakti, is liye ke us ne use diya hi is andaz se hai ke is mein miras nafiz ho gi".
Yazid bin Abi Habib narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled concerning 'Umra -when a man gives a gift to another man, and his descendants, but stipulates that if something happens to you and your descendants, then it will belong to me and my descendants- "It belongs to the one to whom it was given, and to his descendants."

جابر رضی الله عنہ سے روایت ہے کہ عمریٰ کے سلسلہ میں ایک شخص نے ایک شخص کو اور اس کی اولاد کو کوئی چیز ہبہ کی اور اس بات کا استثناء کیا کہ اگر تمہارے ساتھ اور تمہاری اولاد کے ساتھ کوئی حادثہ پیش آ گیا یا تو یہ چیز میری اور میری اولاد کی ہو جائے گی رسول اللہ ﷺ نے فیصلہ دیا کہ وہ چیز اس کی ہو گی جس کو دے دی گئی ہے اور اس کے اولاد کی ہو گی ( استثناء کا کوئی حاصل نہ ہو گا ) ۔
Jabir (رضي الله تعالى عنه) se Riwayat hai ke Amri ke silsila mein aik shakhs ne aik shakhs ko aur us ki aulad ko koi cheez hibah ki aur is baat ka isthnaa kiya ke agar tumhare sath aur tumhari aulad ke sath koi hadsa pesh aa gaya ya to yeh cheez meri aur meri aulad ki ho jayegi Rasool Allah (صلى الله عليه وآله وسلم) ne faisla diya ke woh cheez us ki hogi jis ko de di gayi hai aur us ke aulad ki hogi ( Isthnaa ka koi hasil na hoga ) .
