كِتَابُ الطَّلَاقِ
Who enforced it on him and obligated him to divorce if he timed it
مَنْ كَانَ يُوقِعُهُ عَلَيْهِ، وَيُلْزِمُهُ الطَّلَاقَ إِذَا وَقَّتَ
Musannaf Ibn Abi Shaybah 17841
Hazrat Hammad (may Allah be pleased with him) said: If a man were to say to his wife, "If I marry any woman besides you, then you are divorced", then whenever he marries someone, she [his current wife] will be divorced.
حضرت حماد (رض) فرماتے ہیں کہ اگر ایک آدمی نے اپنی بیوی سے کہا کہ تیرے ہوتے ہوئے اگر میں نے کسی عورت سے شادی کی تو اسے طلاق ہے تو جب بھی یہ کسی سے نکاح کرے گا اسے طلاق ہوجائے گی۔
Hazrat Hammad (RA) farmate hain ki agar aik aadmi ne apni biwi se kaha ki tere hote hue agar maine kisi aurat se shadi ki to use talaq hai to jab bhi ye kisi se nikah karega use talaq hojaegi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا غُنْدَرٌ ، عَنْ شُعْبَةَ ، عَنْ حَمَّادٍ ، فِي رَجُلٍ قَالَ لِامْرَأَتِهِ : كُلُّ امْرَأَةٍ أَتَزَوَّجُهَا عَلَيْكَ فَهِيَ طَالِقٌ قَالَ : « هُوَ وَقْتٌ دَاخِلٌ عَلَيْهِ »
