كِتَابُ الطَّلَاقِ Concerning the man who permits his slave to marry, who said: The divorce is in the hands of the slave.
فِي الرَّجُلِ يَأْذَنُ لِعَبْدِهِ فِي النِّكَاحِ، مَنْ قَالَ: الطَّلَاقُ بِيَدِ الْعَبْدِ

Hazrat Shabi (R.A) said that if a slave gets married with the permission of his master, then the right of divorce will remain with the slave.
حضرت شعبی (رض) فرماتے ہیں کہ اگر غلام نے آقا کی اجازت سے شادی کی تو پھر بھی طلاق کا اختیار غلام کو ہی ہوگا۔
Hazrat Shabi (RA) farmate hain keh agar ghulam ne aqa ki ijazat se shadi ki to phir bhi talaq ka ikhtiyar ghulam ko hi hoga.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا ابْنُ فُضَيْلٍ ، عَنْ حُصَيْنٍ ، عَنِ الشَّعْبِيِّ قَالَ : « إِذَا تَزَوَّجَ بِإِذْنِ سَيِّدِهِ ، فَالطَّلَاقُ بِيَدِ الْعَبْدِ »
