Regarding the man who abstains: He is held back.

Hazrat Umar bin Abdul Aziz (may Allah be pleased with him) said that in the matter of Ila, the decision will rest with the wife.

حضرت عمر بن عبد العزیز (رض) فرماتے ہیں کہ ایلاء میں فیصلہ مُوْلِی پر موقوف ہوگا۔

Hazrat Umar bin Abdul Aziz (RA) farmate hain ke ila mein faisla muli par mauqoof hoga.

حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ ، عَنْ دَاوُدَ ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ، فِي الْمُولِي : « يُوقَفُ »
