كِتَابُ الطَّلَاقِ

What is said about a man who abstains from his wife, then divorces her?

‌مَا قَالُوا: فِي الرَّجُلِ يُولِي مِنِ امْرَأَتِهِ، ثُمَّ يُطَلِّقُهَا

Hazrat Shabi (may Allah be pleased with him) said that divorce and ila (oath of abstinence) are like two horses in a race, whichever comes first will be considered, and if both happen together, then both will be considered.

حضرت شعبی (رض) فرماتے ہیں کہ طلاق اور ایلاء دوڑ کے دو گھوڑوں کی طرح ہیں، جو پہلے ہو اسی کا اعتبار ہوگا اور اگر دونوں اکٹھے ہوں تو دونوں کا اعتبار ہوگا۔

Hazrat Shabi (RA) farmate hain ke talaq aur ila doad ke do ghoron ki tarah hain, jo pehle hua usi ka aitbaar hoga aur agar donon ikatthey hon to donon ka aitbaar hoga.

حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا هُشَيْمٌ ، عَنْ مُغِيرَةَ ، عَنِ الشَّعْبِيِّ قَالَ : « هُمَا كَفَرَسَيْ رِهَانٍ ، أَيُّهُمَا سَبَقَ أَخَذْتُ بِهِ ، وَإِنْ وَقَعَا جَمِيعًا أَخَذْتُ بِهِ »
