كِتَابُ الطَّلَاقِ
Who said: The waiting period of the mother of the child is one menstrual period.
مَنْ قَالَ: عِدَّةُ أُمِّ الْوَلَدِ حَيْضَةٌ

Hazrat Shabi (R.A) said that in case the master of an Umm-e-Walad slave woman passes away, her waiting period (iddah) is one menstrual cycle. If you were to set her waiting period to three menstrual cycles, then why not consider her an inheritor from her master?
حضرت شعبی (رض) فرماتے ہیں کہ ام ولد باندی کے آقا کے انتقال کرجانے کی صورت میں ام ولد باندی کی عدت ایک حیض ہے۔ اگر تم اس کی عدت تین حیض قرار دیتے ہو تو اس کو آقا کا وارث کیوں نہیں بناتے ؟ !۔
Hazrat Shabi (RA) farmate hain ke umme walad bandi ke aqa ke inteqal kar jane ki soorat mein umme walad bandi ki iddat aik haiz hai. Agar tum uski iddat teen haiz qarar dete ho to usko aqa ka waris kyun nahi banate?!
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا حَفْصٌ ، عَنْ إِسْمَاعِيلَ ، عَنِ الشَّعْبِيِّ قَالَ : « عِدَّتُهَا حَيْضَةٌ ، فَلِمَ لَا تُوَرِّثُونَهَا إِذَا جَعَلْتُمُوهَا ثَلَاثَ حِيَضٍ »
