كِتَابُ الطَّلَاقِ
What did they say about a woman who remarries during her waiting period and they are separated, which waiting period does she observe?
مَا قَالُوا فِي الْمَرْأَةِ تُزَوَّجُ فِي عِدَّتِهَا فَفُرِّقَ بَيْنَهُمَا، تَعْتَدُّ، بِأَيِّهِمَا تَبْدَأُ

Hazrat Hukam (R.A.) states that separation will be done between both of them. The woman will complete the first waiting period ('iddah) and then begin the waiting period ('iddah) for the second (divorce or death). She will also receive mahr from the second husband. When her waiting period is complete, then she may marry that second man if she wishes, and if she wishes, she may marry someone else.
حضرت حکم (رض) فرماتے ہیں کہ ان دونوں کے درمیان جدائی کرادی جائے گی۔ عورت پہلی عدت کو پورا کرے گی پھر دوسرے پانی کی عدت شروع کرے گی۔ اس کو دوسرے خاوند سے مہر بھی ملے گا۔ جب عدت پوری ہوجائے تو چاہے تو اس دوسرے مرد سے شادی کرلے اور چاہے تو کسی اور سے شادی کرلے۔
Hazrat Hukam (RA) farmate hain ke in donon ke darmiyaan judaai karadi jayegi. Aurat pehli iddat ko poora karegi phir doosre pani ki iddat shuru karegi. Is ko doosre khaawin se mehr bhi milay ga. Jab iddat poori hojaye to chahe to is doosre mard se shaadi karle aur chahe to kisi aur se shaadi karle.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا يَحْيَى بْنُ عَبْدِ الْمَلِكِ بْنِ أَبِي غَنِيَّةَ ، عَنْ أَبِيهِ ، عَنِ الْحَكَمِ قَالَ : « يُفَرَّقُ بَيْنَهُمَا ، وَتُكْمِلُ عِدَّتَهَا مِنَ الْأَوَّلِ ، وَتَعْتَدُّ مِنْ مَالِ الْآخَرِ ، وَيَكُونُ لَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا ، فَإِذَا انْقَضَتْ عِدَّتُهَا فَلْتَتَزَوَّجْهُ أَوْ غَيْرَهُ إِنْ شَاءَتْ »
