كِتَابُ الطَّلَاقِ What did they say about a man who marries a woman during her waiting period, then divorces her
مَا قَالُوا فِي الرَّجُلِ يَتَزَوَّجُ امْرَأَةً فِي الْعِدَّةِ، ثُمَّ يُطَلِّقُهَا
Musannaf Ibn Abi Shaybah 19239
Hazrat Ata (may Allah be pleased with him) said that there is no legal standing of a void marriage (Nikah Fasid), and there is no concept of divorce in such a union.
حضرت عطائ (رض) فرماتے ہیں کہ ہر نکاح فاسد کا کوئی اعتبار نہیں اور اس کی طلاق کی کوئی حیثیت نہیں۔
Hazrat Ata (RA) farmate hain keh har nikah fasid ka koi aitebar nahin aur us ki talaq ki koi haisiyat nahin.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَطَاءٍ قَالَ : « كُلُّ نِكَاحٍ فَاسِدٍ لَا يَثْبُتُ ، فَلَيْسَ طَلَاقُهُ فِيهِ بِطَلَاقٍ »
