Regarding a drunk person who kills.

Musannaf Ibn Abi Shaybah 29059
Hazrat Saeed and Haram bin Sad both narrate that a camel belonging to the Companions of the Prophet (peace and blessings of Allah be upon him) entered the garden of some people and destroyed their garden. So the Messenger of Allah (peace and blessings of Allah be upon him) gave the verdict that during the day it is the responsibility of the owner to protect the property and the owner of the cattle will pay the damages when the cattle have caused damage at night.
حضرت سعید اور حرام بن سعد دونوں فرماتے ہیں کہ حضرات براء کی ایک اونٹنی کسی قوم کے باغ میں داخل ہوگئی اور ان کے باغ کو تباہ کردیا۔ تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے یہ فیصلہ فرمایا کہ دن میں مال کی حفاظت کرنا مالک کی ذمہ داری ہے اور مویشیوں کا مالک تاوان ادا کرے گا جبکہ مویشی نے رات کو نقصان پہنچایا ہو۔
Hazrat Saeed aur Haram bin Saad donon farmate hain ke Hazrat Bara ki aik untni kisi qaum ke bagh mein dakhil hogayi aur unke bagh ko tabah kardiya. To Rasool Allah (Sallallahu Alaihi Wasallam) ne ye faisla farmaya ke din mein maal ki hifazat karna malik ki zimmedari hai aur moishiyon ka malik tawan ada karega jabke moishi ne raat ko nuqsan pohanchaya ho.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا ابْنُ عُيَيْنَةَ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدٍ ، وَحَرَامِ بْنِ سَعْدٍ : « أَنَّ نَاقَةً لِلْبَرَاءِ دَخَلَتْ حَائِطَ قَوْمٍ فَأَفْسَدَتْ عَلَيْهِمْ ، فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ حِفْظَ الْأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ ، وَأَنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتِ الْمَاشِيَةُ بِاللَّيْلِ »
