Regarding a drunk person who kills.

Musannaf Ibn Abi Shaybah 29062
Hazrat Abdul Hameed's grandfather, Hazrat Rafi' bin Sinan narrates that my parents, one of whom was a disbeliever and the other a Muslim, presented themselves before the Prophet (peace and blessings of Allah be upon him) for the settlement of a dispute concerning me. The Prophet (peace and blessings of Allah be upon him) gave me the choice (to choose between them). I inclined towards the disbeliever. Thereupon, he (peace and blessings of Allah be upon him) prayed, "O Allah! Guide him." Consequently, I turned towards the Muslim. So he (peace and blessings of Allah be upon him) gave the verdict in his (the Muslim's) favor.
حضرت عبد الحمید کے دادا حضرت رافع بن سنان فرماتے ہیں کہ میرے والدین میرے بارے میں جھگڑا لے کر نبی کریم (صلی اللہ علیہ وآلہ وسلم) کے پاس حاضر ہوئے ان دونوں میں سے ایک کافر اور دوسرا مسلمان تھا، تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے حضرت رافع کو اختیار دیا تو وہ کافر کی طرف متوجہ ہونے لگے۔ تو آپ (صلی اللہ علیہ وآلہ وسلم) نے دعا فرمائی ” اے اللہ اس کو ہدایت دے “ تو وہ مسلمان کی طرف متوجہ ہوگئے ۔ تو آپ (صلی اللہ علیہ وآلہ وسلم) نے مسلمان کے لیے ہی ان کا فیصلہ فرما دیا۔
Hazrat Abdul Hameed kay dada Hazrat Rafey bin Sinan farmate hain kay mere waldain mere bare mein jhagra lekar Nabi Kareem (Sallallahu Alaihi Wasallam) kay pass hazir hue, in donon mein se aik kafir aur dusra musalman tha, to Rasool Allah (Sallallahu Alaihi Wasallam) ne Hazrat Rafey ko ikhtiyar diya to woh kafir ki taraf mutwaja hone lage. To aap (Sallallahu Alaihi Wasallam) ne dua farmai "Aye Allah is ko hidayat de" to woh musalman ki taraf mutwaja hogaye. To aap (Sallallahu Alaihi Wasallam) ne musalman kay liye hi in ka faisla farma diya.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا ابْنُ عُلَيَّةَ ، عَنْ عُثْمَانَ الْبَتِّيِّ ، عَنْ عَبْدِ الْحَمِيدِ بْنِ سَلَمَةَ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ،: " أَنَّ أَبَوَيْهِ اخْتَصَمَا فِيهِ إِلَى النَّبِيِّ ﷺ ، أَحَدُهُمَا كَافِرٌ وَالْآخَرُ مُسْلِمٌ ، فَخَيَّرَهُ ، فَتَوَجَّهَ إِلَى الْكَافِرِ ، فَقَالَ : « اللَّهُمَّ اهْدِهِ »، فَتَوَجَّهَ إِلَى الْمُسْلِمِ فَقَضَى لَهُ بِهِ
