Sunan Abi Dawud 3606
Abdullah Ibn Abbas (رضي الله تعالى عنه) narrated that a man from Banu Sahm went out with Tamim ad-Dari and Adiyy ibn Badda. The man of Banu Sahm died in the land where no Muslim was present. When they returned with his inheritance, they (the heirs) did not find a silver cup with lines of gold (in his property). The Apostle of Allah (صلى الله عليه وآله وسلم) administered on oath to them. The cup was then found (with someone) at Makka. They said, we have bought it from Tamim and Adiyy. Then two men from the heirs of the man of Banu Sahm got up and swore saying, our witness is more reliable than their witness. They said that the cup belonged to their man. Ibn Abbas (رضي الله تعالى عنه) said, the following verse was revealed about them – [O you who believe, let two honest men among you be witness when you dictate your last 'will' as (the hour of) death draws near; and if death approaches while you are on a journey, two men other than yours. Detain them after the prayer, and if you doubt their word, make them swear by Allah that: 'We shall not take a bribe even though it be offered by a near relative, nor hide the testimony of Allah, for then we shall surely be sinful.'] (Al-Ma’idah – 106)

عبداللہ بن عباس رضی اللہ عنہما کہتے ہیں کہ بنو سہم کا ایک شخص تمیم داری اور عدی بن بداء کے ساتھ نکلا تو سہمی ایک ایسی سر زمین میں مر گیا جہاں کوئی مسلمان نہ تھا، جب وہ دونوں اس کا ترکہ لے کر آئے تو لوگوں نے اس میں چاندی کا وہ گلاس نہیں پایا جس پر سونے کا پتر چڑھا ہوا تھا تو رسول اللہ ﷺ نے ان دونوں کو قسم دلائی، پھر وہ گلاس مکہ میں ملا تو ان لوگوں نے کہا: ہم نے اسے تمیم اور عدی سے خریدا ہے تو اس سہمی کے اولیاء میں سے دو شخص کھڑے ہوئے اور ان دونوں نے قسم کھا کر کہا کہ ہماری گواہی ان دونوں کی گواہی سے زیادہ معتبر ہے اور گلاس ان کے ساتھی کا ہے۔ راوی کہتے ہیں: یہ آیت: «يا أيها الذين آمنوا شهادة بينكم إذا حضر أحدكم الموت» سورة المائدة: ( ۱۰۶ ) انہی کی شان میں اتری ۔
Abdul-Allah bin Abbas ( (رضي الله تعالى عنه) a kehte hain ke Bano Suhm ka ek shakhs Tamim dari aur Adi bin Bada ke sath nikla to Suhmi ek aisi sar zamin mein mar gaya jahan koi musalman nahin tha, jab woh dono us ka turka le kar aaye to logoon ne is mein chaandi ka woh glass nahin paya jis par sone ka ptr chadha hua tha to Rasool-Allah (صلى الله عليه وآله وسلم) ne in dono ko qasam dilaai, phir woh glass Makkah mein mila to in logoon ne kaha: hum ne ise Tamim aur Adi se khareeda hai to is Suhmi ke auliya mein se do shakhs khare hue aur in dono ne qasam kha kar kaha ke hamari gawahi in dono ki gawahi se ziada mutabar hai aur glass in ke sathi ka hai. Ravi kehte hain: yeh ayat: «Ya ayyuhalladhina amanu shahadah baynakum idha hadara ahadakumul maut» Surah al-Maida: ( 106 ) inhi ki shan mein utri 1؎.
حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا ابْنُ أَبِي زَائِدَةَ، عَنْ مُحَمَّدِ بْنِ أَبِي الْقَاسِمِ، عَنْ عَبْدِ الْمَلِكِ بْنِ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: خَرَجَ رَجُلٌ مِنْ بَنِي سَهْمٍ، مَعَ تَمِيمٍ الدَّارِيِّ، وَعُدَيِّ بْنِ بَدَّاءٍ، فَمَاتَ السَّهْمِيُّ بِأَرْضٍ لَيْسَ بِهَا مُسْلِمٌ، فَلَمَّا قَدِمَا بِتَرِكَتِهِ فَقَدُوا جَامَ فِضَّةٍ مُخَوَّصًا بِالذَّهَبِ، فَأَحْلَفَهُمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ وُجِدَ الْجَامُ بِمَكَّةَ، فَقَالُوا: اشْتَرَيْنَاهُ مِنْ تَمِيمٍ وَعُدَيٍّ، فَقَامَ رَجُلَانِ مِنْ أَوْلِيَاءِ السَّهْمِيِّ فَحَلَفَا لَشَهَادَتُنَا أَحَقُّ مِنْ شَهَادَتِهِمَا، وَإِنَّ الْجَامَ لِصَاحِبِهِمْ قَالَ: فَنَزَلَتْ فِيهِمْ يَأَيُّهَا الَّذِينَ آمَنُوا شَهَادَةُ بَيْنِكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ سورة المائدة آية 106 .
