Sunan Abi Dawud 3940

Abdullah bin Umar (رضي الله تعالى عنه) narrated that the Apostle of Allah (صلى الله عليه وآله وسلم) said, if anyone emancipates his share in slave, a fair price for the slave should be fixed, give his partners their shares, and the slave be thus emancipated. Otherwise, he is emancipated to the extent of the share which he emancipated.

عبداللہ بن عمر رضی اللہ عنہما سے رویت ہے کہ رسول اللہ ﷺ نے فرمایا: جو شخص ( مشترک ) غلام میں سے اپنا حصہ آزاد کر دے تو اس غلام کی واجبی قیمت لگا کر ہر ایک شریک کو اس کے حصہ کے مطابق ادا کرے گا اور غلام اس کی طرف سے آزاد ہو جائے گا اور اگر اس کے پاس مال نہیں ہے تو جتنا آزاد ہوا ہے اتنا ہی حصہ آزاد رہے گا ۔

Abdul-Allah bin Umar ( (رضي الله تعالى عنه) a se rawaiyat hai ke Rasool-Allah (صلى الله عليه وآله وسلم) ne farmaya: jo shakhs (mushtarek) ghulam mein se apna hissa azad kar de to is ghulam ki wajibi qimat laga kar har ek shareek ko is ke hisse ke mutabiq ada karega aur ghulam is ki taraf se azad ho jayega aur agar is ke pass maal nahin hai to jitna azad hua hai utna hi hissa azad rahega.

حَدَّثَنَا الْقَعْنَبِيُّ، ‏‏‏‏‏‏عَنْ مَالِكٍ، ‏‏‏‏‏‏عَنْ نَافِعٍ، ‏‏‏‏‏‏عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، ‏‏‏‏‏‏أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ أُقِيمَ عَلَيْهِ قِيمَةُ الْعَدْلِ، ‏‏‏‏‏‏فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَأُعْتِقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ .
