Musnad Ahmad ibn Hanbal 10916
It is narrated on the authority of Hadrat Abu Hurairah (may Allah be pleased with him) that a dispute arose between two women of the tribe of Banu Hudhail. One of them, who was pregnant, hit the other with a stone, killing her and causing the death of the baby in her womb. In this matter, the Holy Prophet (peace and blessings of Allah be upon him) decided that the family of the killer should pay the blood money (diyah) for the murdered woman and a Gharah (a male or female slave) for her child. Objecting to this decision, a man said (in rhyming prose), "How can reason accept the payment of blood money for this child who neither ate nor drank, nor spoke nor cried? Such things are left behind." Hadrat Abu Hurairah (may Allah be pleased with him) narrated that the Holy Prophet (peace and blessings of Allah be upon him) said, "This man is the brother of soothsayers."

حضرت ابوہریرہ رضی اللہ عنہ سے مروی ہے کہ بنوہذیل کی دو عورتوں کے درمیان جھگڑا ہوگیا ان میں سے ایک نے دوسری کو جو امید سے تھی پتھر دے مارا اور اس عورت کو قتل کردیا اس کے پیٹ کا بچہ بھی مرا ہوا پیدا ہوگیا نبی کریم ﷺ نے اس مسئلے میں قاتلہ کے خاندان والوں پر مقتولہ کی دیت اور اس کے بچے کے حوالے سے ایک غرہ یعنی غلام یا باندی کا فیصلہ فرمایا اس فیصلے پر ایک شخص نے اعتراض کرتے ہوئے (مسجع کلام میں) کہا کہ اس بچے کی دیت کا فیصلہ کیسے عقل میں آسکتا ہے جس نے کچھ کھایا پیا اور نہ بولا چلایا اس قسم کی چیزوں کو تو چھوڑ دیا جاتا ہے بقول حضرت ابوہریرہ رضی اللہ عنہ کے نبی کریم ﷺ نے فرمایا یہ شخص کاہنوں کا بھائی ہے۔
Hazrat Abu Hurairah (رضي الله تعالى عنه) se marvi hai ki Banu Hadil ki do auraton ke darmiyaan jhagda hogaya In mein se ek ne dusri ko jo umid se thi pathar de mara aur us aurat ko qatal kardiya Uske pet ka bachcha bhi mara hua paida hogaya Nabi Kareem (صلى الله عليه وآله وسلم) ne is masle mein qatila ke khandan walon par maqtula ki diyat aur uske bachche ke hawale se ek ghira yani ghulam ya bandi ka faisla farmaya Is faisle par ek shakhs ne aitraz karte hue (musajja kalam mein) kaha ki is bachche ki diyat ka faisla kaise aql mein aa sakta hai jisne kuch khaya piya aur na bola chalaya Is qism ki cheezon ko to chhor diya jata hai Baqol Hazrat Abu Hurairah (رضي الله تعالى عنه) ke Nabi Kareem (صلى الله عليه وآله وسلم) ne farmaya yeh shakhs kahon ka bhai hai.
حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ , حَدَّثَنَا يُونُسُ , حَدَّثَنَا بْنُ شِهَابٍ , عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ , وأبي سَلَمة , عَنْ أَبِي هُرَيْرَةَ , قََالَ: اقْتَتَلَتْ امْرَأَتَانِ مِنْ هُذَيْلٍ , فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا , فَاخْتَصَمُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ," فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ , وَقَضَى بِدِيَةِ الْمَرْأَةِ عَلَى عَاقِلَتِهَا" , فَقَالَ حَمَلُ بْنُ نَابِغَةَ الْهُذَلِيُّ: كَيْفَ أَغْرَمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ , وَلَا نَطَقَ وَلَا اسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " إِنَّمَا هُوَ مِنْ إِخْوَانِ الْكُهَّانِ" , مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ.
