Musnad Ahmad ibn Hanbal 14492
It is narrated on the authority of Sayyidina Jabir (may Allah be pleased with him) that the wife of Sayyidina Bashir (may Allah be pleased with him) said to him: "Gift your slave to my son and make the Prophet (peace and blessings of Allah be upon him) a witness to it." Bashir went to the Prophet (peace and blessings of Allah be upon him) and said: "The daughter of so-and-so (my wife) has asked me to gift my slave to her son and to make you a witness to it." The Prophet (peace and blessings of Allah be upon him) said: "Does this boy have any brothers?" He said: "Yes." The Prophet (peace and blessings of Allah be upon him) said: "Will you give them all the same as you are giving him?" He said: "No." The Prophet (peace and blessings of Allah be upon him) said: "Then this is not appropriate, and I cannot bear witness to any injustice."

سیدنا جابر رضی اللہ عنہ سے مروی ہے کہ سیدنا بشیر رضی اللہ عنہ کی بیوی نے ان سے کہا کہ اپنا غلام میرے بیٹے کو ہبہ کر دو اور اس پر نبی ﷺ کو گواہ بنا لو بشیر وہاں سے نبی ﷺ کی خدمت میں حاضر ہوئے اور عرض کیا: فلاں کی بیٹی (میری بیوی) نے مجھ سے یہ درخواست کی ہے کہ میں اپنا غلام اس کے بیٹے کو ہبہ کر دوں اور اس پر آپ کو گواہ بناؤں، نبی ﷺ نے فرمایا: اس لڑکے کے کچھ اور بھائی ہیں انہوں نے کہا جی ہاں نبی ﷺ نے فرمایا: کیا تم ان سب کو بھی وہی کچھ دو گے جو اسے دے رہے ہو۔انہوں نے کہا ”نہیں۔“ نبی ﷺ نے فرمایا: پھر تو یہ مناسب نہیں ہے اور میں کسی ناحق پر گواہ نہیں بن سکتا۔
Sayyidna Jabir (رضي الله تعالى عنه) se marvi hai ki Sayyidna Bashir (رضي الله تعالى عنه) ki biwi ne un se kaha ki apna ghulam mere bete ko hiba kar do aur is par Nabi (صلى الله عليه وآله وسلم) ko gawah bana lo Bashir wahan se Nabi (صلى الله عليه وآله وسلم) ki khidmat mein hazir hue aur arz kiya: Fulan ki beti (meri biwi) ne mujh se ye darkhwast ki hai ki mein apna ghulam is ke bete ko hiba kar dun aur is par aap ko gawah banaun, Nabi (صلى الله عليه وآله وسلم) ne farmaya: Is ladke ke kuchh aur bhai hain unhon ne kaha ji han Nabi (صلى الله عليه وآله وسلم) ne farmaya: kya tum un sab ko bhi wohi kuchh do ge jo ise de rahe ho. Unhon ne kaha "nahi." Nabi (صلى الله عليه وآله وسلم) ne farmaya: phir to ye munasib nahi hai aur mein kisi nahaq par gawah nahi ban sakta.
حَدَّثَنَا أَبُو النَّضْرِ ، وَحَسَنُ بْنُ مُوسَى ، قَالَا: حَدَّثَنَا زُهَيْرٌ ، حَدَّثَنَا أَبُو الزُّبَيْرِ ، قَالَ حَسَنٌ فِي حَدِيثِهِ: عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ: قَالتِ: امْرَأَةُ بَشِيرٍ انْحَلْ ابْنِي غُلَامَكَ، وَأَشْهِدْ لِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: فَأَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: إِنَّ ابْنَةَ فُلَانٍ سَأَلَتْنِي أَنْ أَنْحَلَ ابْنَهَا غُلَامِي، وَقَالَتْ: وَأَشْهِدْ لِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ:" أَلَهُ إِخْوَةٌ؟" قَالَ: نَعَمْ، فَقَالَ:" فَكُلَّهُمْ أَعْطَيْتَ مِثْلَ مَا أَعْطَيْتَهُ؟" قَالَ: لَا، قَالَ:" فَلَيْسَ يَصْلُحُ هَذَا، وَإِنِّي لَا أَشْهَدُ إِلَّا عَلَى حَقٍّ".
