Musnad Ahmad ibn Hanbal 18148
It is narrated on the authority of Mughira (may Allah be pleased with him) that two women quarreled, one of them killed the other with a tent pole. The Holy Prophet (peace and blessings of Allah be upon him) decided that the blood money for the murder be paid by the tribe of the killer woman. And for the child lost in her womb, he decided that a slave or a bondwoman be given. A villager said, "You are placing the compensation of a life that neither ate nor drank, neither cried nor moved, upon me. Such a matter of life should be disregarded." The Holy Prophet (peace and blessings of Allah be upon him) said, "This is the reasoning of villagers but the decision is still the same. For the retribution of this child, a slave or a bondwoman must be given."

حضرت مغیرہ رضی اللہ عنہ سے مروی ہے کہ دو عورتوں کی لڑائی ہوئی، ان میں سے ایک نے دوسری کو اپنے خیمے کی چوب مار کر قتل کردیا نبی کریم ﷺ نے قاتلہ کے عصبات پر دیت کا فیصلہ فرمایا اور اس کے پیٹ میں موجود بچے کے ضائع ہونے پر ایک باندی یا غلام کا فیصلہ فرمایا ایک دیہاتی کہنے لگا کہ آپ مجھ پر اس جان کا تاوان عائد کرتے ہیں جس نے کھایا نہ پیا، چیخا اور نہ چلایا، ایسی جان کا معاملہ تو ٹال دیا جاتا ہے نبی کریم ﷺ نے فرمایا دیہاتیوں جیسی تک بندی ہے لیکن فیصلہ پھر بھی وہی ہے کہ اس بچے کے قصاص میں ایک غلام یا باندی ہے۔
Hazrat Mugheera razi Allah anhu se marvi hai ki do aurton ki laraai hui, in mein se aik ne dusri ko apne khaime ki chhoob maar kar qatal kardiya Nabi Kareem (صلى الله عليه وآله وسلم) ne qatila ke asbat per deet ka faisla farmaya aur uske pet mein mojood bache ke zaya hone per ek bandi ya ghulam ka faisla farmaya ek dehati kehne laga ki aap mujh per iss jaan ka tauwan aaid karte hain jisne khaya na piya, cheekha aur na chalaya, aisi jaan ka mamla to taal diya jata hai Nabi Kareem (صلى الله عليه وآله وسلم) ne farmaya dehatiyon jaisi tak bandi hai lekin faisla phir bhi wohi hai ki iss bache ke qisas mein ek ghulam ya bandi hai.
حَدَّثَنَا أَبُو سَعِيدٍ ، حَدَّثَنَا زَائِدَةُ ، حَدَّثَنَا مَنْصُورٌ ، عَنْ إِبْرَاهِيمَ ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، عَنْ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنَّ امْرَأَةً ضَرَبَتْهَا امْرَأَةٌ بِعَمُودِ فُسْطَاطٍ، فَقَتَلَتْهَا وَهِيَ حُبْلَى، فَأُتِيَ بِهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، " فَقَضَى فِيهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى عَصَبَةِ الْقَاتِلَةِ بِالدِّيَةِ، وَفِي الْجَنِينِ غُرَّةٌ" . فَقَالَ: عَصَبَتُهَا أَنْدِي مَنْ لَا طَعِمَ، وَلَا شَرِبَ، وَلَا صَاحَ، فَاسْتَهَلَّ، مِثْلُ ذَلِكَ يُطَلُّ. فَقَالَ:" سَجْعٌ مِثْلُ سَجْعِ الْأَعْرَابِ". وقَالَ شُعْبَةُ : سَمِعْتُ عُبَيْدًا .
