Musnad Ahmad ibn Hanbal 18149
It is narrated on the authority of Mughira (may Allah be pleased with him) that two women had a fight. One of them hit the other with a tent pole and killed her. The Holy Prophet (peace and blessings of Allah be upon him) decided that the blood money (diyah) for the murder would be paid by the family of the killer. He also ruled that the loss of the baby in the womb of the murdered woman would be compensated with a slave or a female slave. A Bedouin said, "O Messenger of Allah! How can you hold me responsible for a life that had not yet eaten or drank, cried or screamed? Such a life is usually disregarded." The Holy Prophet (peace and blessings of Allah be upon him) replied, "Your logic is like that of the Bedouins, but the ruling stands: a slave or a female slave as compensation for the baby."

حضرت مغیرہ رضی اللہ عنہ سے مروی ہے کہ دو عورتوں کی لڑائی ہوئی، ان میں سے ایک نے دوسری کو اپنے خیمے کی چوب مار کر قتل کردیا نبی کریم ﷺ نے قاتلہ کے عصبات پر دیت کا فیصلہ فرمایا اور اس کے پیٹ میں موجود بچے کے ضائع ہونے پر ایک باندی یا غلام کا فیصلہ فرمایا ایک دیہاتی کہنے لگا کہ آپ مجھ پر اس جان کا تاوان عائد کرتے ہیں جس نے کھایا نہ پیا، چیخا اور نہ چلایا، ایسی جان کا معاملہ تو ٹال دیا جاتا ہے نبی کریم ﷺ نے فرمایا دیہاتیوں جیسی تک بندی ہے لیکن فیصلہ پھر بھی وہی ہے کہ اس بچے کے قصاص میں ایک غلام یا باندی ہے۔
Hazrat Mugheera Razi Allaho Anho Se Marvi Hai Ke Do Aourton Ki Larai Hoi, Un Mein Se Aik Ne Dusri Ko Apne Khaime Ki Choob Maar Kar Qatal Kardiya Nabi Kareem Sallallaho Alaihi Wasallam Ne Qatila Ke Asbat Par Deet Ka Faisla Farmaya Aur Iske Pet Mein Mojood Bache Ke Zaya Hone Par Ek Bandi Ya Ghulam Ka Faisla Farmaya Ek Dehati Kehne Laga Ke Aap Mujh Par Is Jaan Ka Tawan Aaed Karte Hain Jisne Khaya Na Piya, Chekha Aur Na Chalaya, Aisi Jaan Ka Mamla To Taal Diya Jata Hai Nabi Kareem Sallallaho Alaihi Wasallam Ne Farmaya Dehatiyon Jaisi Tak Bandi Hai Lekin Faisla Phir Bhi Wohi Hai Ke Is Bache Ke Qisas Mein Ek Ghulam Ya Bandi Hai.
حَدَّثَنَا عَفَّانُ ، حَدَّثَنَا شُعْبَةُ ، قَالَ: مَنْصُورٌ أَخْبَرَنِي، قَالَ: سَمِعْتُ إِبْرَاهِيمَ يُحَدِّثُ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ، فَغَارَتَا، فَضَرَبَتْهَا بِعَمُودِ فُسْطَاطٍ، فَقَتَلَتْهَا، فَاخْتَصَمُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللَّهِ، كَيْفَ نَدِي مَنْ لَا أَكَلَ، وَلَا شَرِبَ، وَلَا صَاحَ فَاسْتَهَلَّ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟" قَالَ: " فَقَضَى فِيهِ غُرَّةً". قَالَ: وَجَعَلَهُ عَلَى عَاقِلَةِ الْمَرْأَة .
