Musnad Ahmad ibn Hanbal 18177
It is narrated on the authority of Mughirah (may Allah be pleased with him) that two women had a fight. One of them killed the other with a tent pole. The Holy Prophet (peace and blessings of Allah be upon him) ruled that the blood money (diyat) for the murder would be paid by the tribe of the killer woman. He (peace and blessings of Allah be upon him) also ruled that for the loss of the baby in the womb of the murdered woman, a slave or a female slave would be given. A villager said, "O Messenger of Allah! You are placing the compensation of a life upon me that neither ate nor drank, neither cried nor moved. Such a life should be disregarded." The Holy Prophet (peace and blessings of Allah be upon him) said, "Your analogy is like that of the villagers (a common saying in that time referring to a flawed argument), but the verdict remains the same: for the life of this child, a slave or a female slave must be given."

حضرت مغیرہ رضی اللہ عنہ سے مروی ہے کہ دو عورتوں کی لڑائی ہوئی، ان میں سے ایک نے دوسری کو اپنے خیمے کی چوب مار کر قتل کردیا نبی کریم ﷺ نے قاتلہ کے عصبات پر دیت کا فیصلہ فرمایا اور اس کے پیٹ میں موجود بچے کے ضائع ہونے پر ایک باندی یا غلام کا فیصلہ فرمایا ایک دیہاتی کہنے لگا کہ آپ مجھ پر اس جان کا تاوان عائد کرتے ہیں جس نے کھایا نہ پیا، چیخا اور نہ چلایا، ایسی جان کا معاملہ تو ٹال دیا جاتا ہے نبی کریم ﷺ نے فرمایا دیہاتیوں جیسی تک بندی ہے لیکن فیصلہ پھر بھی وہی ہے کہ اس بچے کے قصاص میں ایک غلام یا باندی ہے۔
Hazrat Mugheerah RA se marvi hai keh do auraton ki laraai hui, un mein se aik ne dusri ko apne khaimey ki choob maar kar qatal kardiya Nabi Kareem SAW ne qatila ke asbaat par deet ka faisla farmaya aur uss ke pait mein mojood bachay ke zaya hone par aik bandi ya ghulam ka faisla farmaya aik dehati kehne laga keh aap mujh par iss jaan ka taawan aaid karte hain jis ne khaya na piya, cheekha aur na chalaya, aisi jaan ka mamla to taal diya jata hai Nabi Kareem SAW ne farmaya dehatiyon jaisi talk bandi hai lekin faisla phir bhi wohi hai keh iss bachay ke qisas mein aik ghulam ya bandi hai.
حَدَّثَنَا عَبْدُ الرَّحْمَنِ ، عَنْ سُفْيَانَ . ح وَحَدَّثَنَا زَيْدُ بْنُ الْحُبَابِ ، أَخْبَرَنَا سُفْيَانُ ، الْمَعْنَى، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، قَالَ زَيْدٌ: الْخُزَاعِيُّ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنَّ ضُرَّتَيْنِ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ فُسْطَاطٍ، فَقَتَلَتْهَا، " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالدِّيَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ، وَفِيمَا فِي بَطْنِهَا غُرَّةٌ" . قَالَ الْأَعْرَابِيُّ: أَتُغَرِّمُنِي مَنْ لَا أَكَلَ، وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" أسَجْعٌ كَسَجْعِ الْأَعْرَابِ"، وَلِمَا فِي بَطْنِهَا غُرَّةٌ.
