Musnad Ahmad ibn Hanbal 18606
It is narrated on the authority of Bara (may Allah be pleased with him) that there was a very troublesome she-camel. Once, it entered a garden and caused some damage. The Holy Prophet (peace and blessings of Allah be upon him) gave the verdict that the protection of the garden during the day is the responsibility of its owner, and the protection of the animals during the night is the responsibility of their owners. And whoever's animal causes damage at night, its compensation will be upon the owner of the animal.

حضرت براء رضی اللہ عنہ سے مروی ہے کہ ایک اونٹنی بہت تنگ کرنے والی تھی ایک مرتبہ اس نے کسی باغ میں داخل ہو کر اس میں کچھ نقصان کردیا نبی کریم ﷺ نے اس کا فیصلہ یہ فرمایا کہ دن کے وقت باغ کی حفاظت مالک کے ذمے ہے اور جانوروں کی حفاظت رات کے وقت ان کے مالکوں کے ذمے ہے اور جو جانور رات کے وقت کوئی نقصان کردے اس کا تاوان جانور کے مالک پر ہوگا۔
Hazrat Bara raziallahu anhu se marvi hai ki aik untni bohat tang karne wali thi aik martaba usne kisi bagh mein dakhil ho kar us mein kuch nuqsan kardia Nabi Kareem (صلى الله عليه وآله وسلم) ne uska faisla ye farmaya ki din ke waqt bagh ki hifazat malik ke zimme hai aur janwaron ki hifazat raat ke waqt unke malikon ke zimme hai aur jo janwar raat ke waqt koi nuqsan karde uska tawan janwar ke malik par hoga.
حَدَّثَنَا مُحَمَّدُ بْنُ مُصْعَبٍ ، حَدَّثَنَا الْأَوْزَاعِيُّ ، عَن الزُّهْرِيِّ ، عَن حَرَامِ بْنِ مُحَيِّصَةَ ، عَن الْبَرَاءِ بْنِ عَازِبٍ ، أَنَّهُ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ، فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ،" فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا، وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا، وَأَنَّ مَا أَصَابَتْ الْمَاشِيَةُ بِاللَّيْلِ، فَهُوَ عَلَى أَهْلِهَا" .
