The Musnad of Abdullah ibn al-Abbas ibn Abd al-Muttalib (may Allah be pleased with them both)

Musnad Ahmad ibn Hanbal 2087
Our master, the son of Umar, may Allah be pleased with him, said: "We used to give land on sharecropping and did not see any harm in it." Later, our master, Rafi' bin Khadij, may Allah be pleased with him, informed us that the Prophet, peace and blessings of Allah be upon him, prohibited it. The narrator said: "I mentioned this matter to Thawban, whereupon he narrated to me this statement of the Prophet, peace and blessings of Allah be upon him, on the authority of our master, Ibn 'Abbas, may Allah be pleased with him: 'It is better for one of you to give his land as a gift to his brother than to take from him a fixed rent for it.'"

سیدنا ابن عمر رضی اللہ عنہ فرماتے ہیں کہ ہم بٹائی پر زمین دے دیا کرتے تھے اور اس میں کوئی حرج نہیں سمجھتے تھے، بعد میں سیدنا رافع بن خدیج رضی اللہ عنہ نے بتایا کہ نبی ﷺ نے اس سے منع فرمایا ہے، راوی کہتے ہیں کہ میں نے یہ بات طاؤس سے ذکر کی تو انہوں نے سیدنا ابن عباس رضی اللہ عنہما کے حوالے سے نبی ﷺ کا یہ ارشاد نقل کیا کہ ”تم میں سے کسی شخص کا اپنی زمین اپنے بھائی کو بطور ہدیہ کے پیش کر دینا اس سے بہتر ہے کہ وہ اس سے اس پر کوئی معین کرایہ وصول کرے۔“
Sayyedna Ibn Umar RA farmate hain keh hum batai per zameen de diya karte thay aur is mein koi haraj nahin samjhte thay, baad mein Sayyedna Rafi bin Khadeej RA ne bataya keh Nabi SAW ne is se mana farmaya hai, ravi kehte hain keh maine yeh baat Taaus se zikr ki to unhon ne Sayyedna Ibn Abbas RA ke hawale se Nabi SAW ka yeh irshad naqal kya keh "Tum mein se kisi shakhs ka apni zameen apne bhai ko bataur hadiya ke pesh kar dena is se behtar hai keh woh is se is per koi muayyan kiraya wasool kare."
حَدَّثَنَا وَكِيعٌ ، حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، قَالَ: سَمِعْتُ ابْنَ عُمَرَ ، يَقُولُ: كُنَّا نُخَابِرُ وَلَا نَرَى بِذَلِكَ بَأْسًا حَتَّى زَعَمَ رَافِعُ بْنُ خَدِيجٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْهُ، قَالَ عَمْرٌو ذَكَرْتُهُ لِطَاوُسٍ، فَقَالَ طَاوُسٌ : قَالَ ابْنُ عَبَّاسٍ : إِنَّمَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" يَمْنَحُ أَحَدُكُمْ أَخَاهُ الْأَرْضَ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ لَهَا خَرَاجًا مَعْلُومًا".
