Musnad Ahmad ibn Hanbal 4552

It is narrated on the authority of Sayyidina Ibn Umar (may Allah be pleased with him) that the Holy Prophet (peace and blessings of Allah be upon him) said: “Whoever sells a tree in which date palms have been grafted, its fruit shall belong to the seller, unless the buyer makes it a condition (of sale).”

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ نبی کریم ﷺ نے ارشاد فرمایا: ”جو شخص کسی ایسے درخت کو فروخت کرے جس میں کھجوروں کی پیوندکاری کی گئی ہو تو اس کا پھل بائع (بچنے والا) کی ملیکت میں ہو گا الاّ یہ کہ مشتری (خریدنے والا) شرط لگا دے۔“

Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki Nabi Kareem (صلى الله عليه وآله وسلم) ne irshad farmaya: "Jo shakhs kisi aise darakht ko farokht kare jismein khajuron ki paiwandkari ki gayi ho to uska phal ba'i (bechne wala) ki milkiyat mein hoga illa yeh ki mushtaree (kharidne wala) shart laga de."

حَدَّثَنَا سُفْيَانُ ، عَنِ الزُّهْرِيِّ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَال:" مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا مُؤَبَّرًا، فَالثَّمَرَةُ لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
