Musnad Ahmad ibn Hanbal 5129
A man from Najran asked Ibn Umar (may Allah be pleased with him) two things: one about raisins and dates, and the other about a Salam sale (forward sale) of a date tree. Ibn Umar (may Allah be pleased with him) said: Once, a man intoxicated by drinking wine made from raisins and dates was brought to the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) carried out the prescribed punishment on him and forbade mixing the two. Also, a man made a Salam sale of a date tree to another man, but it did not bear fruit that year. When he asked for his money back, the owner of the tree refused. The man came to the Prophet (peace and blessings of Allah be upon him) and the Prophet (peace and blessings of Allah be upon him) asked the owner of the tree: "Did your tree not bear fruit?". He replied: "No." The Prophet (peace and blessings of Allah be upon him) said: "Why then are you withholding his money?" So, he returned his money. After that, the Prophet (peace and blessings of Allah be upon him) forbade Salam sales until the fruit had ripened.

نجران کے ایک آدمی نے سیدنا ابن عمر رضی اللہ عنہما سے سوال کرتے ہوئے کہا کہ میں آپ سے دو چیزوں کے متعلق پوچھتا ہوں، ایک تو کشمش اور کھجور کے متعلق اور ایک کھجور کے درخت میں بیع سلم کے متعلق (ادھار)۔ سیدنا ابن عمر رضی اللہ عنہما نے فرمایا کہ ایک مرتبہ نبی ﷺ کے پاس نشے میں دھت ایک شخص کو لایا گیا، اس نے کشمش اور کھجور کی شراب پی تھی، نبی ﷺ نے اس پر حد جاری فرمائی اور ان دونوں کو اکٹھا کرنے سے منع فرمایا۔ نیز ایک آدمی نے دوسرے کے لئے کھجور کے درخت میں بیع سلم کی، لیکن اس سال پھل ہی نہیں آیا، اس نے اپنے پیسے واپس لینا چاہے تو اس نے انکار کر دیا، وہ آدمی نبی ﷺ کے پاس آ گیا، نبی ﷺ نے درختوں کے مالک سے پوچھا کہ کیا تمہارے درختوں پر پھل نہیں آیا؟ اس نے کہا: نہیں، نبی ﷺ نے فرمایا: ”تو پھر اس کے پیسے کیوں روک رکھے ہیں؟“ چنانچہ اس نے اس کے پیسے لوٹا دئیے، اس کے بعد نبی ﷺ نے پھل پکنے تک بیع سلم سے منع فرما دیا۔
Najran ke aik aadmi ne Sayyiduna Ibn Umar ( (رضي الله تعالى عنه) a se sawal karte huye kaha ki mein aap se do cheezon ke mutalliq poochta hun, aik to kishmish aur khajoor ke mutalliq aur aik khajoor ke darakht mein bay salam ke mutalliq (udhaar). Sayyiduna Ibn Umar ( (رضي الله تعالى عنه) a ne farmaya ki ek martaba Nabi (صلى الله عليه وآله وسلم) ke paas nashe mein dhut ek shakhs ko laya gaya, us ne kishmish aur khajoor ki sharab pi thi, Nabi (صلى الله عليه وآله وسلم) ne us par had jari farmai aur in donon ko akatha karne se mana farma diya. Neez aik aadmi ne dusre ke liye khajoor ke darakht mein bay salam ki, lekin us saal phal hi nahin aaya, us ne apne paise wapas lena chahe to us ne inkar kar diya, woh aadmi Nabi (صلى الله عليه وآله وسلم) ke paas aa gaya, Nabi (صلى الله عليه وآله وسلم) ne darakhton ke malik se poocha ki kya tumhare darakhton par phal nahin aaya? Us ne kaha: nahin, Nabi (صلى الله عليه وآله وسلم) ne farmaya: ”to phir us ke paise kyun rok rakhe hain?“ Chunache us ne us ke paise lauta diye, us ke baad Nabi (صلى الله عليه وآله وسلم) ne phal pakne tak bay salam se mana farma diya.
حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، حَدَّثَنَا شُعْبَةَ ، سَمِعْتُ أَبَا إِسْحَاقَ ، سَمِعْتُ رَجُلًا مِنْ أَهْلِ نَجْرَانَ، قَالَ: سَأَلْتُ ابْنَ عُمَرَ ، قُلْتُ: إِنَّمَا أَسْأَلُكَ عَنْ شَيْئَيْنِ: عَنِ السَّلَمِ فِي النَّخْلِ، وَعَنِ الزَّبِيبِ وَالتَّمْرِ، فَقَالَ: أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ نَشْوَانَ، قَدْ شَرِبَ زَبِيبًا وَتَمْرًا، قَالَ: فَجَلَدَهُ الْحَدَّ، وَنَهَى أَنْ يُخْلَطَا، قَالَ: وَأَسْلَمَ رَجُلٌ فِي نَخْلِ رَجُلٍ فَلَمْ يَحْمِلْ نَخْلُهُ، قَالَ: فَأَتَاهُ يَطْلُبُهُ، قَالَ: فَأَبَى أَنْ يُعْطِيَهُ، قَالَ: فَأَتَيَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ:" أَحَمَلَتْ نَخْلُكَ؟" قَالَ: لَا، قَالَ:" فَبِمَ تَأْكُلُ مَالَهُ؟! قَالَ: فَأَمَرَهُ فَرَدَّ عَلَيْهِ، وَنَهَى عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ.
