Musnad Ahmad ibn Hanbal 5434
Anas bin Sirin said: Once, Ibn Umar (may Allah be pleased with him) divorced his wife while she was menstruating. Umar (may Allah be pleased with him) mentioned this to the Prophet (peace and blessings of Allah be upon him), so he said: "Tell him to take his wife back, and when she is clean, then he may divorce her during a time of purity." I asked, "Did you consider the divorce that he issued during her period as valid?" He said, "Why should it not be considered?"

انس بن سرین کہتے ہیں کہ ایک مرتبہ سیدنا ابن عمر رضی اللہ عنہما نے اپنی بیوی کو ایام کی حالت میں طلاق دے دی، سیدنا عمر رضی اللہ عنہ نے نبی ﷺ سے اس کا تذکر ہ کیا، تو انہوں نے فرمایا: ”اسے کہو کہ اپنی بیوی سے رجوع کر لے، جب وہ پاک ہو جائے تو اس کو ایام طہارت میں اسے طلاق دے دے۔“ میں نے پوچھا کہ کیا آپ نے وہ طلاق شمار کی تھی جو ایام کی حالت میں دی تھی؟ انہوں نے کہا کہ اسے شمار نہ کرنے کیا وجہ تھی؟
Ans bin Sirin kehte hain ki ek martaba Sayyidna Ibn Umar Radi Allahu anhuma ne apni biwi ko ayyam ki halat mein talaq de di, Sayyidna Umar Radi Allahu anhu ne Nabi (صلى الله عليه وآله وسلم) se iska tazkira kiya, to unhon ne farmaya: “Ise kaho ki apni biwi se ruju kar le, jab wo pak ho jaye to isko ayyam e taharat mein use talaq de de.” Maine poocha ki kya aap ne wo talaq shumar ki thi jo ayyam ki halat mein di thi? Unhon ne kaha ki use shumar na karne ki kya wajah thi?.
حَدَّثَنَا بَهْزٌ ، حَدَّثَنَا شُعْبَةُ ، أَخْبَرَنِي إِنْ شَاءَ اللَّهُ أَنَسُ بْنُ سِيرِين ، سَمِعْتُ ابْنَ عُمَرَ ، يَقُولُ: طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" لِيُرَاجِعْهَا حَتَّى تَطْهُرَ، ثُمَّ لِيُطَلِّقْهَا"، قَالَ: قُلْتُ: احْتُسِبَ بِهَا؟ قَالَ: فَمَهْ؟!.
