Musnad Ahmad ibn Hanbal 5720
Naim bin Naham (may Allah be pleased with him), “whom the Prophet (peace and blessings of Allah be upon him) called righteous,” said: Ibn Umar (may Allah be pleased with him) requested his father to send a marriage proposal to the daughter of Salih. Umar (may Allah be pleased with him) said, "She has orphaned nephews, and she will not prefer us over them." Ibn Umar (may Allah be pleased with him) went to his paternal uncle, Zaid bin Khattab (may Allah be pleased with him), and asked him to send a marriage proposal. So, Zaid (may Allah be pleased with him) himself went to Salih (may Allah be pleased with him) and said, "Abdullah bin Umar (may Allah be pleased with him) has sent me with a marriage proposal for your daughter." Salih (may Allah be pleased with him) said, "I have orphaned nephews here, and I cannot lower my own flesh and blood to raise yours. I call you to witness that I have married this girl to so-and-so." The girl's mother wanted her to be married to Ibn Umar (may Allah be pleased with him). She came to the Prophet (peace and blessings of Allah be upon him) and said, "O Prophet of Allah! Ibn Umar (may Allah be pleased with him) asked for my daughter's hand in marriage, but her father married her to his orphaned nephew, who is under his care, without even consulting me." The Prophet (peace and blessings of Allah be upon him) summoned Salih and said, "Did you decide about your daughter's marriage without consulting her mother?" He replied, "Yes, I did." The Prophet (peace and blessings of Allah be upon him) said, "Consult women in their matters, even if they are virgins." Salih (may Allah be pleased with him) said, "I did this only because I already possess as much wealth as Abdullah bin Umar (may Allah be pleased with him) would give her as a dowry (I am indebted to him, so I did not feel comfortable giving my daughter in marriage to him in this situation)."

نعیم بن نحام رضی اللہ عنہ ”جنہیں نبی ﷺ نے صالح کا خطاب دیا تھا“ کہتے ہیں کہ سیدنا ابن عمر رضی اللہ عنہما نے اپنے والد سے درخواست کی کہ صالح کی بیٹی سے میرے لئے پیغام نکاح بھیجیں، سیدنا عمر رضی اللہ عنہ کہنے لگے کہ اس کے یتیم بھتیجے ہیں، وہ ہمیں ان پر ترجیح نہیں دیں گے، ابن عمر رضی اللہ عنہما اپنے چچا زید بن خطاب رضی اللہ عنہ کے پاس چلے گئے اور ان سے بھی پیغام نکاح بھیجنے کے لئے کہا، چنانچہ زید رضی اللہ عنہ خود ہی صالح رضی اللہ عنہ کے پاس چلے گئے اور فرمایا کہ مجھے عبداللہ بن عمر رضی اللہ عنہ نے آپ کی بیٹی کے لئے اپنی طرف سے نکاح کا پیغام دے کر بھیجا ہے، صالح رضی اللہ عنہ نے کہا کہ میرے یتیم بھتیجے موجود ہیں، میں اپنے گوشت کو نیچا کر کے آپ کے گوشت کو اونچا نہیں کر سکتا، میں آپ کو گواہ بنا کر کہتا ہوں کہ اس لڑکی کا نکاح میں نے فلاں شخص سے کر دیا۔ لڑکی کی ماں سیدنا ابن عمر رضی اللہ عنہما سے اس کی شادی کرنا چاہتی تھی، وہ نبی ﷺ کی خدمت میں حاضر ہوئی اور کہنے لگی، اے اللہ کے نبی! ابن عمر رضی اللہ عنہما نے میری بیٹی کا اپنے لئے رشتہ مانگا تھا لیکن اس کے باپ نے اپنی پرورش میں موجود یتیم بھتیجے سے اس کا نکاح کر دیا اور مجھ سے مشورہ تک نہیں کیا، نبی ﷺ نے صالح کو بلا بھیجا اور فرمایا کہ کیا تم نے اپنی بیٹی کا رشتہ اپنی بیوی کے مشورے کے بغیر ہی طے کر دیا؟ انہوں نے عرض کیا جی ہاں ایسا ہی ہے نبی ﷺ نے فرمایا: ”عورتوں سے ان کے متعلق مشورہ کر لیا کرو جب کہ وہ کنواری بھی ہوں۔“ صالح رضی اللہ عنہ کہنے لگے کہ میں نے یہ کام صرف اس وجہ سے کیا ہے کہ عبداللہ بن عمر رضی اللہ عنہما جو مہر اسے دیں گے، میرے پاس ان کا اتنا ہی مال پہلے سے موجود ہے (میں ان کا مقروض ہوں، اس لئے مجھے اس حال میں اپنی بیٹی ان کے نکاح میں دینا گوارا نہ ہوا)۔
Naeem bin Nahaam (رضي الله تعالى عنه) "jinhen Nabi (صلى الله عليه وآله وسلم) ne Saleh ka khitab diya tha" kahte hain ke Sayyiduna Ibn Umar ( (رضي الله تعالى عنه) a ne apne walid se darkhwast ki ke Saleh ki beti se mere liye paigham nikah bhejen, Sayyiduna Umar (رضي الله تعالى عنه) kahne lage ke uske yateem bhateeje hain, woh humain un par tarjeeh nahin denge, Ibn Umar ( (رضي الله تعالى عنه) a apne chacha Zaid bin Khattab (رضي الله تعالى عنه) ke paas chale gaye aur unse bhi paigham nikah bhejne ke liye kaha, chunanche Zaid (رضي الله تعالى عنه) khud hi Saleh (رضي الله تعالى عنه) ke paas chale gaye aur farmaya ke mujhe Abd Allah bin Umar ( (رضي الله تعالى عنه) a ne aap ki beti ke liye apni taraf se nikah ka paigham de kar bheja hai, Saleh (رضي الله تعالى عنه) ne kaha ke mere yateem bhateeje maujood hain, main apne gosht ko neecha kar ke aap ke gosht ko ooncha nahin kar sakta, main aapko gawah bana kar kahta hun ke is ladki ka nikah maine falan shakhs se kar diya. Ladki ki maan Sayyiduna Ibn Umar ( (رضي الله تعالى عنه) a se uski shadi karna chahti thi, woh Nabi (صلى الله عليه وآله وسلم) ki khidmat mein hazir hui aur kahne lagi, aye Allah ke Nabi! Ibn Umar ( (رضي الله تعالى عنه) a ne meri beti ka apne liye rishta manga tha lekin uske baap ne apni parwarish mein maujood yateem bhateeje se uska nikah kar diya aur mujhse mashwara tak nahin kiya, Nabi (صلى الله عليه وآله وسلم) ne Saleh ko bula bheja aur farmaya ke kya tumne apni beti ka rishta apni biwi ke mashware ke baghair hi tay kar diya? Unhon ne arz kiya ji haan aisa hi hai Nabi (صلى الله عليه وآله وسلم) ne farmaya: "Auraton se unke mutalliq mashwara kar liya karo jab ke woh kunwari bhi hon." Saleh (رضي الله تعالى عنه) kahne lage ke maine yeh kaam sirf is wajah se kiya hai ke Abd Allah bin Umar ( (رضي الله تعالى عنه) a jo mehr use denge, mere paas unka utna hi maal pahle se maujood hai (main unka maqrooz hun, isliye mujhe is haal mein apni beti unke nikah mein dena gawara na hua).
حَدَّثَنَا يُونُسُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا لَيْثٌ ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ ، عَنْ إِبْرَاهِيمَ بْنِ صَالِحٍ ، وَاسْمُهُ الَّذِي يعرف به نعيم بن النحام، وكان رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَمَّاهُ صَالِحًا، أَخْبَرَهُ: أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ , قَالَ لِعُمَرَ بْنِ الْخَطَّابِ: اخْطُبْ عَلَيَّ ابْنَةَ صَالِحٍ , فَقَالَ: إِنَّ لَهُ يَتَامَى، وَلَمْ يَكُنْ لِيُؤْثِرَنَا عَلَيْهِمْ، فَانْطَلَقَ عَبْدُ اللَّهِ إِلَى عَمِّهِ زَيْدِ بْنِ الْخَطَّابِ لِيَخْطُبَ، فَانْطَلَقَ زَيْدٌ إِلَى صَالِحٍ، فَقَالَ: إِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ أَرْسَلَنِي إِلَيْكَ يَخْطُبُ ابْنَتَكَ، فَقَالَ: لِي يَتَامَى، وَلَمْ أَكُنْ لِأُتْرِبَ لَحْمِي , وَأَرْفَعَ لَحْمَكُمْ، أُشْهِدُكُمْ أَنِّي قَدْ أَنْكَحْتُهَا فُلَانًا , وَكَانَ هَوَى أُمِّهَا إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَأَتَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ: يَا نَبِيَّ اللَّهِ، خَطَبَ عَبْدُ اللَّهِ بْنُ عُمَرَ ابْنَتِي، فَأَنْكَحَهَا أَبُوهَا يَتِيمًا فِي حَجْرِهِ، وَلَمْ يُؤَامِرْهَا، فَأَرْسَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى صَالِحٍ، فَقَالَ:" أَنْكَحْتَ ابْنَتَكَ وَلَمْ تُؤَامِرْهَا؟" , فَقَالَ: نَعَمْ، فَقَالَ:" أَشِيرُوا عَلَى النِّسَاءِ فِي أَنْفُسِهِنَّ"، وَهِيَ بِكْرٌ، فَقَالَ صَالِحٌ: فَإِنَّمَا فَعَلْتُ هَذَا لِمَا يُصْدِقُهَا ابْنُ عُمَرَ، فَإِنَّ لَهُ فِي مَالِي مِثْلَ مَا أَعْطَاهَا.
