Musnad Ahmad ibn Hanbal 5788
It is narrated on the authority of Sayyidina Ibn Umar (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: “Whoever sells a tree in which date palms have been grafted, its fruit will be the property of the seller, unless the buyer makes it a condition at the time of purchase (that I am buying this tree with its fruit).”

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ رسول اللہ ﷺ نے ارشاد فرمایا:”جو شخص کسی ایسے درخت کو فروخت کرے جس میں کھجوروں کی پیوندکاری کی گئی ہو تو اس کا پھل بائع کی ملکیت میں ہو گا، الاّ یہ کہ مشتری خریدتے وقت اس کی بھی شرط لگادے (کہ میں یہ درخت پھل سمیت خرید رہا ہوں)۔“
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki Rasul Allah (صلى الله عليه وآله وسلم) ne irshad farmaya: "Jo shakhs kisi aise darakht ko farokht kare jis mein khajuron ki paiwandkari ki gayi ho to uska phal ba'i ki milk mein hoga, illa yeh ki mushtiri kharidte waqt uski bhi shart laga de (keh mein yeh darakht phal samet kharid raha hun)."
حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ ، حَدَّثَنَا عُبَيْدُ اللَّهِ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:" مَنْ اشْتَرَى نَخْلًا قَدْ أُبِّرَتْ، فَثَمَرَتُهَا لِلَّذِي أَبَّرَهَا، إِلَّا أَنْ يَشْرِطَ الَّذِي اشْتَرَاهَا".
