باب لا شفعة فيما ينقل ويحول
Sunan al-Kubra Bayhaqi 11595
Jabir (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said, "Pre-emption (right of purchase) applies to every shared property, whether land or garden. It is not permissible for a partner to sell his share until he informs his partner, for the partner has more right to it (i.e., to purchase it) unless he grants permission (to sell it to someone else)."

(١١٥٩٥) حضرت جابر (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شفعہ ہر حصے میں ہے، زمین میں بھی اور باغ میں بھی، صحیح نہیں ہے کہ کوئی بیچے جب تک وہ اپنے شریک کو نہ بتائے۔ پھر وہ بیچے تو اس کا شریک زیادہ حق دار ہے حتی کہ وہ اجازت دے دے۔
Hazrat Jabir (RA) se riwayat hai ki Rasul Allah (SAW) ne farmaya: Shafa har hisse mein hai, zameen mein bhi aur bagh mein bhi, sahih nahin hai ki koi beche jab tak woh apne sharik ko na batae. Phir woh beche to uska sharik zyada haqdaar hai hatta ki woh ijazat de de.
It is narrated on the authority of Ubadah bin Samit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) gave the right of Shuffah (preemption) in houses and lands amongst partners.

(١١٥٩٦) حضرت عبادہ بن صامت (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے شرکاء کے درمیان گھروں میں اور زمینوں میں شفعہ کا فیصلہ کیا۔
Hazrat Ubadah bin Samat (RA) se riwayat hai ki Rasul Allah (SAW) ne shuraka ke darmiyan gharon mein aur zameenon mein shafa ka faisla kiya.
(11597) (b) Narrated Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "There is no pre-emption except in a house and immovable property." And it is narrated from Hasan that there is no pre-emption in animals.

(١١٥٩٧) (ب) حضرت ابوہریرہ (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شفعہ نہیں ہے مگر گھر میں اور غیر منقولی جائیداد میں اور حسن سے منقول ہے کہ حیوان میں شفعہ نہیں ہے۔
(11597) (b) Hazrat Abu Hurairah (ra) se riwayat hai ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Shafa nahin hai magar ghar mein aur ghair manqooli jaidad mein aur Hasan se manqool hai ki hewan mein shafa nahin hai.
It has been narrated on the authority of Ibn Abbas that the Prophet (peace and blessings of Allah be upon him) said: The partner has the right of preemption, and the right of preemption applies to everything.

(١١٥٩٨) حضرت ابن عباس سے روایت ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شریک حق شفعہ رکھتا ہے اور شفعہ ہر چیز میں ہے۔
(11598) Hazrat Ibn Abbas se riwayat hai ki Nabi ((صلى الله عليه وآله وسلم)) ne farmaya : Shareek haq shafa rakhta hai aur shafa har cheez mein hai.
(11602) It is narrated from Ibn Abbas that the Prophet (peace and blessings of Allah be upon him) said: The right of pre-emption applies to slaves and everything else. In another (weak) narration, it is stated that the right of pre-emption applies to slaves and everything.

(١١٦٠٢) حضرت ابن عباس سے روایت ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شفعہ غلام میں ہے اور ہرچیز میں ہے۔ ایک اور روایت میں ہے کہ غلام میں اور ہر چیز میں شفعہ ہے۔ (ضعیف )
Hazrat Ibn Abbas se riwayat hai ki Nabi ((صلى الله عليه وآله وسلم)) ne farmaya : Shafa ghulam mein hai aur har cheez mein hai. Ek aur riwayat mein hai ki ghulam mein aur har cheez mein shafa hai. (Zaeef).
