Sunan al-Kubra Bayhaqi 11230
Hakim narrated from Ali (may Allah be pleased with him) that if the mortgaged item is destroyed while in the possession of the mortgagee, then both parties should return any excess to each other.

(١١٢٣٠) حکم نے حضرت علی (رض) سے روایت کیا ہے کہ رھن میں اگر شی مرہونہ ہلاک ہوجائے تو دونوں زیادتی کو واپس کریں گے۔
Hukm ne Hazrat Ali (RA) se riwayat ki hai ki rahn mein agar shai marhoona halaak ho jaye to donon ziyadati ko wapas karenge.
١١٢٣٠ - أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدِ بْنِ شَبَّانَ، ثنا عَبْدُ الْبَاقِي بْنُ قَانِعٍ، ثنا إِبْرَاهِيمُ بْنُ هَاشِمٍ، ثنا إِبْرَاهِيمُ بْنُ الْحَجَّاجِ، ثنا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنِ الْحَكَمِ، عَنْ عَلِيٍّ،فِي الرَّهْنِ إِذَا هَلَكَ:" يَتَرَادَّانِ الْفَضْلَ "
