Sunan al-Kubra Bayhaqi 11415
(11415) (a) Haritha bin Mudar narrates that I offered the morning prayer with Ibn Mas'ud (may Allah be pleased with him). He narrated the incident of Ibn Nawwaha and his companions and also their martyrdom with Musaylimah the liar, and Ibn Mas'ud ordered the killing of Ibn Nawwaha. Then he consulted the people about that group. Jarir and Ash'ath stood up and both said: "Seek repentance from them and take a guarantee from their tribe." Then they repented and their tribe gave a guarantee for them. (b) Al-Bukhari said: Umar (may Allah be pleased with him) sent Hamza to collect charity. There, a man committed fornication with a woman who was not permissible for him. Hamza took a guarantee from the man until he came to Umar (may Allah be pleased with him). Umar (may Allah be pleased with him) flogged him with 100 lashes. Then he confessed and made the excuse of ignorance.

(١١٤١٥) (الف) حارثہ بنمضرّفرماتے ہیں کہ میں نے ابن مسعود (رض) کے ساتھ صبح کی نماز پڑھی، اس نے ابن نواحہ اور اس کے ساتھیوں کا قصہ بیان کیا اور مسیلمہ کذاب کے ساتھ ان کی شہادت بھی بیان کی اور ابن مسعود نے ابن نواحہ کو قتل کرنے کا حکم دیا۔ پھر اس جماعت کے بارے میں لوگوں سے مشورہ کیا۔ جریر اور اشعث کھڑے ہوئے اور دونوں نے کہا : ان سے توبہ کراؤ اور ان کے قبیلے سے ضمانت مانگو۔ پھر انھوں نے توبہ کرلی اور ان کے قبیلے نے ان کی ضمانت دے دی۔ ( ب ) قال البخاری : حضرت عمر (رض) نے حمزہ کو صدقہ وصول کرنے بھیجا، وہاں پہ ایک آدمی اپنی بیوی کی لونڈی پر واقع ہوا۔ حمزہ نے آدمی سے ضمانت لی یہاں تک کہ عمر (رض) کے پاس آئے۔ عمر نے اسے ١٠٠ کوڑے لگائے، پھر اس نے قبول کیا اور جہالت کا عذر کیا۔
(11415) (alif) Harisa bin Mudar farmate hain ki maine Ibn Masood (rz) ke sath subah ki namaz parhi, usne Ibn Nawaha aur uske sathiyon ka qissa bayan kiya aur Musailma kazzab ke sath unki shahadat bhi bayan ki aur Ibn Masood ne Ibn Nawaha ko qatl karne ka hukum diya. Phir us jamat ke bare mein logon se mashwara kiya. Jarir aur Ashas kharay huye aur donon ne kaha: Unse tauba karao aur unke qabile se zamanat mango. Phir unhon ne tauba karli aur unke qabile ne unki zamanat de di. (be) Qal al-Bukhari: Hazrat Umar (rz) ne Hamza ko sadqa wasool karne bheja, wahan pe ek aadmi apni biwi ki laundi par waqe hua. Hamza ne aadmi se zamanat li yahan tak ki Umar (rz) ke paas aaye. Umar ne use 100 koray lagaye, phir usne qubool kiya aur jahalat ka uzr kiya.
١١٤١٥ - أَخْبَرَنَا أَبُو صَالِحِ بْنُ أَبِي طَاهِرٍ، أنبأ جَدِّي يَحْيَى بْنُ مَنْصُورٍ، ثنا أَبُو بَكْرِ بْنُ إِسْمَاعِيلَ، ثنا يَحْيَى بْنُ دُرُسْتَ بْنِ زِيَادٍ، ثنا أَبُو عَوَانَةَ، عَنْ أَبِي إِسْحَاقَ،عَنْ حَارِثَةَ بْنِ مُضَرِّبٍ قَالَ:" صَلَّيْتُ الْغَدَاةَ مَعَ عَبْدِ اللهِ بْنِ مَسْعُودٍ، فَذَكَرَ قِصَّةَ ابْنِ النَّوَّاحَةِ وَأَصْحَابِهِ وَشَهَادَتِهِمْ لمُسَيْلِمَةَ الْكَذَّابِ بِالرِّسَالَةِ، وَإِنَّ عَبْدَ اللهِ بْنَ مَسْعُودٍ رَضِيَ اللهُ عَنْهُ أَمَرَ بِقَتْلِ ابْنِ النَّوَّاحَةِ، ثُمَّ إِنَّهُ اسْتَشَارَ النَّاسَ فِي أُولَئِكَ النَّفَرِ،فَقَامَ جَرِيرٌ وَالْأَشْعَثُ فَقَالَا:اسْتَتِبْهُمْ وَكَفِّلْهُمْ عَشَائِرَهُمْ، فَاسْتَتَابَهُمْ فَتَابُوا، فَكفَّلَهُمْ عَشَائِرَهُمْ "ذَكَرَهُ الْبُخَارِيُّ فِي التَّرْجَمَةِ بِلَا إِسْنَادٍ،قَالَ الْبُخَارِيُّ:وَقَالَ أَبُو الزِّنَادِ: عَنْ مُحَمَّدِ بْنِ حَمْزَةَ بْنِ عَمْرٍو الْأَسْلَمِيِّ، عَنْ أَبِيهِ، أَنَّ عُمَرَ رَضِيَ اللهُ عَنْهُ بَعَثَهُ مُصَدِّقًا، فَوَقَعَ رَجُلٌ عَلَى جَارِيَةِ امْرَأَتِهِ، فَأَخَذَ حَمْزَةُ مِنَ الرَّجُلِ كُفَلَاءَ حَتَّى قَدِمَ عَلَى عُمَرَ، وَكَانَ عُمَرُ قَدْ جَلَدَهُ مِائَةً، فَصَدَّقَهُمْ وَعَذَرَهُ بِالْجَهَالَةِ
