Sunan al-Kubra Bayhaqi 11416
It is narrated from Shabi that the testimony of a person in a Hadd punishment is not permissible, nor is bail permissible in a Hadd punishment.
Grade: Da'if
(١١٤١٦) شعبی سے روایت ہے کہ حد میں کسی آدمی کی گواہی جائز نہیں اور نہ حد میں ضمانت جائز ہے۔
(11416) Shobai se riwayat hai ki hadd mein kisi aadmi ki gawahi jaiz nahin aur na hadd mein zamanat jaiz hai.
١١٤١٦ - أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْوَلِيدِ الْفَقِيهُ، ثنا السَّرَّاجُ، ثنا يَعْقُوبُ الدَّوْرَقِيُّ، عَنْ هُشَيْمٍ، عَنْ مُطَرِّفٍ،عَنِ الشَّعْبِيِّ قَالَ:" لَا تَجُوزُ شَهَادَةُ الرَّجُلِ عَلَى شَهَادَةِ الرَّجُلِ فِي حَدٍّ، وَلَا كَفَالَةَ فِي حَدٍّ "وَرُوِّينَاهُ أَيْضًا عَنْ شُرَيْحٍ وَمَسْرُوقٍ وَإِبْرَاهِيمَ، وَرُوِيَ فِيهِ حَدِيثٌ بِإِسْنَادٍ ضَعِيفٍ
