Sunan al-Kubra Bayhaqi 11909
Ata' bin Sa'ib said: I went to Shurayh in the time of Bishr bin Marwan, while he was the judge in those days. I said: O Abu Umayyah! Give me a Fatwa. He said: O my nephew! I am a judge, not a Mufti. I said: I have not come with the intention of dispute. A man from the tribe has unlawfully occupied a house. Ata said: He entered from the door of the Masjid. I heard him while he entered and (the man) was following behind him. He was saying to Habib, who had come for the dispute: Tell the man: It is not permissible to prevent (someone) from the obligation of Allah.

(١١٩٠٩) عطاء بن سائب فرماتے ہیں کہ میں بشر بن مروان کے زمانہ میں شریح کے پاس آیا اور وہ ان دنوں قاضی تھے، میں نے کہا : اے ابوامیہ ! مجھے فتویٰ دو ۔ انھوں نے کہا : اے میرے بھتیجے ! میں قاضی ہوں، مفتی نہیں۔ میں نے کہا : میں لڑائی کے ارادے سے نہیں آیا، قبیلے کے ایک آدمی نے گھر روک لیا ہے، عطاء نے کہا : وہ مسجد والے دروازے سے داخل ہوئے ۔ میں نے سنا جب وہ داخل ہوئے اور ان کے پیچھے ہولیا۔ وہ حبیب سے کہہ رہے تھے جو جھگڑا لے کر آیا تھا کہ آدمی کو بتادو : اللہ کے فرائض سے روکنا جائز نہیں ہے۔
Ata bin Saib farmate hain ki main Bashar bin Marwan ke zamane mein Sharaeh ke paas aaya aur wo un dino qazi thay, maine kaha : aye Abu Umama! mujhe fatwa do. Unhon ne kaha: aye merey bhatijay! main qazi hun, mufti nahin. Maine kaha: main larai ke irade se nahin aaya, qabile ke ek aadmi ne ghar rok liya hai, Ata ne kaha: wo masjid wale darwaze se dakhil huye. Maine suna jab wo dakhil huye aur un ke peeche haulia. Wo Habib se keh rahe thay jo jhagra lekar aaya tha ki aadmi ko batado: Allah ke faraiz se rokna jaiz nahin hai.
١١٩٠٩ - أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ، أنبأ عَبْدُ اللهِ بْنُ جَعْفَرِ بْنِ دَرَسْتَوَيْهِ، ثنا يَعْقُوبُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ الْحُمَيْدِيُّ، ثنا سُفْيَانُ،ثنا عَطَاءُ بْنُ السَّائِبِ قَالَ:أَتَيْتُ شُرَيْحًا فِي زَمَنِ بِشْرِ بْنِ مَرْوَانَ، وَهُوَ يَوْمَئِذٍ قَاضٍ،فَقُلْتُ:يَا أَبَا أُمَيَّةَ أَفْتِنِي،فَقَالَ:يَا ابْنَ أَخِي، إِنَّمَا أَنَا قَاضٍ وَلَسْتُ بِمُفْتٍ،قَالَ:فَقُلْتُ: إِنِّي وَاللهِ مَا جِئْتُ أُرِيدُ خُصُومَةً، إِنَّ رَجُلًا مِنَ الْحِيِّ جَعَلَ دَارَهُ حَبْسًا،قَالَ عَطَاءٌ:فَدَخَلَ مِنَ الْبَابِ الَّذِي فِي الْمَسْجِدِ فِي الْمَقْصُورَةِ،فَسَمِعْتُهُ حِينَ دَخَلَ وَتَبِعْتُهُ وَهُوَ يَقُولُهُ لِحَبِيبٍ الَّذِي يُقَدِّمُ الْخُصُومَ إِلَيْهِ:" أَخْبِرِ الرَّجُلَ أَنَّهُ لَا حَبْسَ عَنْ فَرَائِضِ اللهِ عَزَّ وَجَلَّ "
